4 weeks ago, I got a speeding ticket for motorway works on A64 in Tadcaster doing 53 through 40mph limit average camera at 19.31pm

I was in Colchester Vet at 5.37pm with my car same reg number, I have fill out form to say I was not the driver and my car never been in Yorkshire on that day. I posted by first class with proof statement from my vet to say I was with him at that afternoon.

Now it is 4 weeks I have not hear from Yorkshire Police. Do the police reply me? or ignore when they found I was innocent?

Because my 14 years of driving never caught speeding! so I don't know how the process it works.

Went to your local police station to make a comlaint that your number plate was cloned.

The post office said it can not accept record sign on address with P.O. BOX, that is why I go for 1st class.

I have not been to my local police but I will do today

Someone may be able to correct me, but my understanding is that a photo is not supplied unless the registered keeper has a problem identifying the driver. Certainly on the two occasions I have received a NIP for speeding, no photo was supplied.

No I don’t think that they do. I got a speeding ticket in London whilst the car and I were in France. Phoned up Met Police and photo is a silver hatchback and mine a dark green cabriolet. “Oh,”, says PC, “ that’s a 6 in registration not an 8.”

What you should have done was to ask to see any photographs they may have to "help you identify the driver". They rarely do help with that but they would help you with the identity of your car. However, you cannot do that now as you have already replied and your 28 days is up.

No they don’t ignore the matter. The police do not routinely make enquiries when they receive such a response as yours. They will usually initiate court proceedings under Section 172 of the Road Traffic Act which places a duty on the Registered Keeper to identify the driver of a vehicle at the time of an alleged offence. They will let a court decide whether you are guilty of that offence or not. This could take up to six months from the date of the alleged offence. If you are convicted the offence carries a hefty fine, six points and an endorsement code (MS90) that insurers hate, leading you to suffer increased premiums for up to five years.

You should enquire with the ticket office firstly to ensure they have your reply. (If they have no reply at all.you face the same allegation as above). Then you should ask them to check to see whether there has been a plate mis-read. Finally you should ask whether they intend prosecuting you under S172. If they do intend to do so, although you are not entitled to it at this stage, you should ask for any photographs they have to help resolve this. If they will not provide them you willl have to wait until the court proceedings begin (when you will be entitled to them).

Firstly, don't assume that your plate MUST have been cloned. Equally possible (in fact, far more likely) for it to be an error of some sort.

In any event, you will hear back from them. They will want to look at the picture, look at the numberplate in the picture closely, possibly contact the vet to ensure the letter is genuine ... all this before they then come to a decision ... only then will they contact you again.

Don't panic over the dire postings so far regarding you facing huge fines, points, etc for various offences.. You weren't there, your car wasn't there, and if it did come to a courtroom, you can prove as such - meaning you aren't going to be facing any penalties whatsoever.

The most the ticket office will do is check the photographs for a mis-read and check the DVLA records to ensure the make and model of the vehicle tie up. Anything else which you suggest makes you innocent will have to be dealt with by a court. The ticket office does not get involved with assessing the strength of defence evidence. Nor does it get involved with checking vehicles closely.

My post did not contain any dire warnings. I simply explained what will happen. You may well be easily able to show that it was not your vehicle but if the photograph is of a vehicle bearing your registration mark and is of the same make, model and colour you will have to defend the allegation.

Has this happen to me a while back.

Same car same colour. Photo was just the number plate. Thank goodness mine had the supplying dealers details on it. The cloned one didn't and there was nothing else to differentiate the back of their car and mine.
