As the Telegraph article clearly states the law requires the discount rate used in calculationg compensation to be set by reference to return on gilts. It also reports that the discount rate has been unchanged since 2001.

You don't need to be an investment wizard to know that gilt returns have plummeted since 2001 and have bumped along the bottom for pretty much last decade. Looks like an act of negligence, or Micawberism on an epic scale, for government to have left rate for so long.

The effect on motorists will be small beer compared to cost borne by NHS for hospital negligence payouts.

Telegraph also mentions in passing other reforms to personal injury process. Article below is of course written from lawyer's perspective but nonetheless.....

Virtually every few months there's something that is going to cause premiums to rise : a couple of years ago it was the requirement that male / female drivers couldn't be treated differently any more, and countless other articles over the years.

Yet my premiums are the same as, if not slightly lower than, 5 years ago. Just a couple of weeks ago we took out a new policy on the Z4 - we moved provider, due to the existing one rocketing the premium up from £260 to 350. Amusingly, we found they were one of the cheaper ones as a new customer, at £240. But we moved to a new provider at £212 - more on the principle of sticking 2 fingrs up at them for trying to rip us off.

Yes, Autonet, I'm talking about you (if you ever happen to read this). Loyalty cuts both ways, and I have to trust the company I'm dealing with to continue sending them my business ... trying to shaft me tends to destroy that trust.
