vauxhall - do i have any chance of getting a refund or more - iclegg

i have drafted this is this the right thing to send trading standards

sorry if this is in the wrong thread.


I baught a vauxhall astra vxr (sa57lyy) payed £5000 cash and
my car which was a vauxhall vectra (wf07hlg) which totalling £6000.

One of the front tyres was cracked and replaced 3 days later by psc.
The passenger side seatbelt was jammed shut and wouldent
work which they said they would get fixed before i pick up the car which was not. The gear box felt
strange which they said if the car breaks down they will sort
it i was assured its all under warrenty.

They had my car for 10 days to fix the seatbelt and get the tyre changed 3 days into owning it.

The gear box broke another 31 days into having the car
which was taken to a garrage and warrenty wise payed £1000
and psc payed the £600 this took 3 weeks.

My car was dammaged during the 3 weeks it was been repaired the front bumper had been cracked they said it wasnt them.

After i got the car back it started to loose power nothing
happend when accelerating and it was making a loud noise
going over bumps plus a noise on start up.

I took it to a garage and they stripped it down asked if i had the car long and have i modified it which i have not.
The garage found the front of the chassis was all bent
and screws where holding the front wing inplace
it had been in a crash befour i baught it and psc did not tell me this.

The garrage found that the exahust had been tamperd with (d catting)
it was missing a bolt out of the rear tyre
and most of the car had been welded back together he also said the car does not sit right
indicating its been in a major accident.

all of which where present on passing an mot.

I went to psc on 17/10/2016 to ask for my money back for the car,
they tryed to sell me a more expensive car and then tryed to swap my
vxr for another one all i asked was my money back.
They have told me they will speak with there manager and have
a decision thursday.
psc said they might not have the full amount of money because i have used the car. The car has been in the garrage more than i have driven it in the past
3 months proof can be found if needed.

They have acknowledged that the car was in an accident before they sold it me and that it passed an m.o.t inproper.
psc said they did not know it was like this when they sold it me, which i said you should have known.
psc said all there cars get m.o.ted at the same place and there all fine this one is just unlucky.

ek motors are wrighting up an evidence report on the car
they also carried out work on shock absorbers which cost £300 that i have to pay for because the warrenty psc gave me wont pay out.

I have not driven the car since 10/10/2016 and will not be doing until its return has been finalised


baught the car on 18/7/2016
taken back on the 21/7/2016 for seatbelt + split tyre to be fixed/replaced.
got my car back on the 1/8/2016

car broke down on the 2/9/2016
towed by psc on the 8/9/2016
dident get the car back untill 30/9/2016
total:39 days out of 91 days of owning it

money lost on this car;

ek motors repairs £300+
car insurance when repairs carried out: £ 39 days worth = £115 per month
I had to get taxis to work over the 39 days of not having my car which cost me £19 per day there and back.

You are entitled, under the Consumer Rights Act, to reject the car. However, you must allow the garage to have ONE attempt at fixing any fault - if the fix fails, ONLY then you can reject the car.

However, as you have had the car for more than 30 days, you are NOT entitled to a complete refund : they are allowed to make a 'reasonable deduction' for the use you have had of the car.

The car insurance, taxi costs, etc. are NOT something you can get refunded.

even if the car is cat d when they sold it me with out them saying so?

Any motor dealer is obliged to state if the vehicle is Cat D/C

So you only got £1000 part ex for a Vectra the same year as the Astra, for which you paid £5000 cash on top?

Was the Vectra a wreck or MOT failure, seems like a big difference in values?

This trader doesn't fill me with confidence he will be wiling to refund without going the legal route.

Look at this link from Which. In the circumstances, undisclosed severe damage, it seems you may well be entitled to a refund. The dealer may get a rap on the knuckles, but given the parlous state of Trading Standards due to cuts, I fear not! www.which.co.uk/consumer-rights/advice/the-second-...s
