What if...dpf removed unknowingly - brum

Having read on other forums boasting about dpf removal and in some cases the cat too. Just read about one guy tweaking his map so it smokes less when he sells it.

Whats the situation if an innocent buyer purchases said car privately without being told its illegal status, only to have it fail its next mot or some future mot? Has a fraud taken place? Does the purchaser have recourse in law against the seller?

It'll depend what questions the buyer asks of the seller - if the seller assumes and doesn't ask I don't see there's any comeback against a private seller.

But isnt there an presumption that the car must be roadworthy unless otherwise stated?

I think you'd have to prove that the previous owner knew about the removed items.

Difficult, to say the least. They could just argue that it must have been an owner before them.
