Driver Speed Awareness Course Criteria - Armitage Shanks {p}

Having just received my first NIP for 15 years I am interested to see what the liits are, below which one is offered a Course, if eleigible. I think it is a welcome alternative to points on a licence and is also an earner for the Police. I think this why the limits are so generous! In Leicestershire the thresholds are:-

42 in a 30

53 in a 40

64 in a 50

75 in a 60

86 in a 70

Seems generous. I shall be on a Course!

I was always under the impression that the official tolerance from ACPO Ltd (the private company comprised of chief constables who decide which offense they are going to go for this week) was posted speed limit +10% + 2 mph which would make the max for a 70 limit to 79 mph etc.

The guideline of 10% +2mph is the lowest speed they take action, not the highest you get away with.

In a 70 limit, 78 is ok 79 isn't.

I beg to differ that 78 is ok and 79 isn't. My cruise control was set to 78 on the M74 travelling south, above the 1st bridge over the M6 i was clocked at 78 and received a FPN through the post or a speed awareness course.

So obviously each force treats speeding differently.

My response about 78 vs 79 related to a posting on ACPO guidelines - and is correct in that context.

I'm well aware that not all police forces apply the APCO guidelines and that even when they do, any individual officer can override them if circumstances warrant.

Most forces in England use APCO guidelines most of the time - APCO doesn't apply in Scotland but Police Scotland has it's own guidelines which are similar (but not identical).

Recent publicity is that Bedfordshire will give zero tolerance in future.

Untrue!

If they ask about speed awareness courses you have to answer honestly - but I've never been asked - just "any accidents, claims, convictions or pending prosecutions"

ACPO publish guidelines for England and Wales giving the speeds that action is taken and the speeds at which more severe action is taken. Individual police forces don't have to apply the guidelines (Bedfordshire doesn't) and individual officers have discretion not to use the guidelines if they consider it inappropriate.

So it's a grey area as to whether you must inform your insurers.

Yes - a fixed penalty FPN is the same as a court conviction and be notified to your insurer - a speed awareness course is different.

Afraid it is true, you have to notify an insurance company of any event, whether the actual Q is asked or not. Do you not read HJ's comments?

The same applies to other types of insurance, its a 'catch all phrase' the insurance company needs to be informed of any event that may inpact on their offer to ensure

HJ seems to be out of date. The Consumer Protection Act 2012 did away with traps like "catch-all" requirements. Instead, at renewal etc the insurer must ask about issues which it needs to know. www.abi.org.uk/~/media/Files/Documents/Publication...f
This Act puts the onus on the insurer to ask and on the insured to answer to the best of their ability.
Appendix A gives a question set: it deals with convictions not courses on the matter at hand.

Theye were in an A4 size leaflet of notes and explanations which accompanied my NIP, from Leicestershire Police. These are the guidlines they set for offering a course, unless you have done one in the precceding 3 years etc! It also stated their time "trigger" for jumping red light was 2.99 seconds
