My girlfriend bought a VW Polo in December 2114, she has had a letter from VW saying it is affected with the emissions scandal.

She bought it second hand through a VW dealership with finance also through VW.

The question I have could she hand ther car back asking for a full refund rather than just taking it back to be sorted out

The emissions issue is only relevant when the vehicle is being tested for NOx pollution. It has no relevance at all for normal driving and use. It has no effect on fuel consumption. It does not make the vehicle unfit or unsuitable for the purposes for which it was sold. The purchaser has suffered no loss.

So it has no effect on the purchaser, with the exception of the recall work, which many dealers will be trying to schedule along with routine servicing to make things easier for customers and technicians.

There is a possibility or indeed a probablility that her vehicle will be emitting more NOx pollution in normal driving than the level certified by the tests. This has been found to be the case for many makes of car and indeed VW group cars have been found to be less bad than some others. Now here's the rub: the people disadvantaged by this are not the purchasers, unless they set a condition on their purchase that NOx emissions would be a specific value. The people disadvantaged are a larger and more diffuse and unidentifiable group who inhale the emissions from VW, Ford, Ferrari and the rest, and whose health is damaged by these emissions. The exact damage caused by your Polo and the exact nature of the injury suffered by the vicitms, including their identity, is impossible to determine.

I bought my Seat Leon 28 months ago and have done 18,000 miles. During that time its run perfectly and has been very economical and a pleasure to drive. Its not affected by the recall since its a petrol TSi.

But due to the scandal and subsequent recall there will probably be a stigma attached to ALL VAG group vehicles for many years to come which will probably affect their resale values.

So should I ask for full and expect a refund.

Or am I dreaming.

I think the stigma shoul die down after a few months, certainly for petrol vehicles, provided that VW do carry out the fixes on the affected diesel cars. Once something drops out of the headlines, people's memories are usually short.

Whilst I agree with what you're saying to some extent, I think you're overlooking the weight people put on being environmentally friendly nowadays. Can't say I'm too fussed myself but I have many mates who are and the ones that are affected feel really let down.
Found an article from the bloke who discovered the issue and he said something about some of the cars having more than 15x the emissions they said when people bought the cars: vw-compensation.net/emissions-updates/insight-into.../
It's not just about measurable damage anyway, they offered a service and they haven't delivered. Between any problems with recalls and just being dishonest, I fully see why people think it's a problem.

If we are being environmental why would they choosea diesel car? It's well known that they put out a lot of pollution other than CO2. I'm sure there are people that choose a car based on its environmental credentials but most people would only look at MPG and road tax prices.

Surely the whole point about VW's position is that they claimed to have the nasty emissions of diesels under control, even being able to meet stringent US standards. VW were pretty much regarded as having salvaged the reputation of diesel engines over there.

It's not only VW but diesels in general that have taken a knock.

I am sure if you had purchase the car after Oct 2015 technically yes, but unlikely to be considered reasonable.

The press don't really report all the facts. VW only decided to stop using the merc supplied system after 2009 in the US as they didn't want a competing companys system in their cars.

So they decided to develop their own, that sadly did work as they wanted to meet EURO 6 or US standards.

So basically VW fudged it and lied. No one else did the same. So on that basis yes there are question to be answered. Its been found that in real life some ford & BMWs also produces more than the allow NOx, but then again thats not what is required by the standards.

In the UK unlike the US our MOT system does not test for NOx so not a MOT failure. No tax issue.

If you purchase the car as EURO 6 complaint then it may really and that could be grounds to reject. But would a court see this as reasoable?
