Hello All,

I'm wondering if anyone could help me with some information as I cant seem to find what I'm looking for anywhere. An employee was recently caught by the police driving dangerously, they had pulled out of a party (were not under the influence of drugs or alcohol) drove down a road with two 17/18 year olds in the boot of the car with the boot open, other people were in the passenger seats, with no lights on except the hazard lights, driving in the middle of the road and nearly hit an on duty police car. This was 9 days after completing a second speed awareness course. The officer was on his own but called in the incedent over his radio with the driver and car details, he said the driver would be expecting a court summons. A week later the employee said that the officer had called them up on the phone and said that he was not taking the case any further largely due to the fact that they had been polite and compliant. Nowhere can I find whether or not this is police protocall so would love it if someone could clear up for me if this could be a possibility or if the employee is likely lying and will soon be summoned to court. I know what I would do.......phone the local cop shop and ask to speak to the traffic sargeant. No doubt it will be documented but I would imagine you will need to have a very good reason for asking.

I assume the employee drives company vehicles for you or uses their own vehicle whilst in your employ?

If so if you don't already, it might prudent to bring in regular licence checks just as good HGV/PSV operators do, maybe one in a few days time.

Ours are checked and photographed every three months, we also have to sign waivers that we haven't been caught for anything at all and no prosecutions pending.

I doubt the old bill will say anything, it'll be data prtection or some such waffle.

If you are that worried then do what Ted Crilly ^^^^^ suggests.

From information given a plethora of offences but officer can report then not submit paperwork. Maybe one off duty against a number of defendants witnesses it was a no no to go ahead????

For dangerous driving a NOIP required but as officer spoke to driver at time this complied with.

For sure you are not entitled to any information as the employer. You require definate policys in place to protect yourself and the company against the actions of individauls.

So for example a max. number of accistents acceptable and points etc

Thanks for the replies, the speeding awareness courses are in place of points on a licence and if they have been let off this offence then again there would be no penalty incured. I just don't see how such an offence could be dropped, it was called in by an on duty officer, and he did give a NOIP on the scene, I am not sure though if it is the procedure for the officer to personally call them up and say "don't do it again", it seem like BS to me but I cannot find the information on google, hence going to forums to ask. Legalities aside it is an idiotic way to be driving.

As others have suggested make it company policy for drivers to produce their licence for inspection and copying on a annual basis (at the very minimum). Add to that a new staff policy that makes it a disciplinable offence if they do not imform you of any motoring offence or pending prosecution immediately it occurs.

Surprised its not a condition of your company insurance already, its a condition where I work and the wife used to spend much time chasing licenses where she last worked. The threat of various sanctions which would have impacted on their abilty to work always focused their minds.

To obtain the check code / view the licence, you require the driving licence number and home postcode (on the photocard) and the NI number.

It should be noted that you cannot check your employee's licence without their explicit consent. It is a criminal offence.
