Someone drove into my beloved VW Camper Van while it was parked outside my house.

I contacted my insurance who advised me to go through CCL Accident Support (A Hertz Company).

They supplied me with a courtesy car.

The 3rd party's insurance came & inspected my van (which in my opinion was undriveable) & they told me A) it was borderline write off & B) I should be getting my own quotes.

I told this to CCL who arranged to take my van to their approved garage for a quote & that I needed to do nothing.

Now because of this, the 3rd party's insurance are refusing to pay for the courtesy car & my van's storage at the garage.

It has now been 39 days since the incident. The courtesy car is costing over £400 a week, the van repairs were quoted as £1600 & the garage storage fees are over £500.

I have made a complaint to CCL 1 week ago. I contacted the FOS, but they say I need to give CCL 8 weeks before they will take on the case.

I feel like these companies have actually stolen my van & I'm really worried about the increasing car hire & storage costs.

What should I do?

Your insurance Company did you no favours in passing you on to a Claims Management Company

1) You have presumably sighned a contract which means you are liable for all expenses to date

2) I have never been charged a storage fee, on the couple of occassions over the last 20+ years

3) 39 days is an outrageous time to receive a quote for what looks like fairly minor damage

4) A 4 week rental from the likes of Avis for an Astra sized vehicle would be less than a third of what you have contracted for.

Can you do anything, probably not without paying for all expenses to date, then making a claim against the management company

I don't understand. Can you explain with a bit more detail?

Have the TP insurance company agreed to pay your damage claim to your vehicle? If not, then why not?

If so, they can only complain about the duration of the process, not whether or not they will pay your expenses. If the delay is your fault, then they can discount it. But they cannot discount it all.

If the basis of their complaint is the time that everything is taking, then what is taking the time?

Who was delaying the actions?

I need to understand the dates & process;

  • Accident date
  • Reported to your insruance company
  • Reported to the Claims Handler
  • Date your side got a quotation and forwarded it to them
  • Date they made their settlement offer
  • Reasons for any gaps/delays.
