My insurance co refusing to give me TP details - mickyd38

I had an RTA collision around 12 months ago when hit in the rear by a third party vehicle. All the repairs were dealt with and no claims bonus reinstated.

I now wish to make a claim for personal injury compensation, but my insurance company are refusing to give me any of the third party details ie name, registration number, insurers etc.

Without this information my Solicitors (who have also been refused the information) can not pursue the claim and i was wondering if

a) has anyone else has come across this problem

b) am i legally entitled to this information

Surely you must have or had it as you would have supplied the details to your insurance company in the first place

Yes i did have the information at one point but given this was over 12 months ago i have thrown away the details.

Surely any claim that you make against the third party should be made via your insurance ?

Or have you been contacted by one of the shyster accident claims companies, and are dealing with them ? If an insurance company feels that a claim is likely to be fraudulent (for example the damage was minimal, no hospital was needed) then they may well be taking this viewpoint, and responding accordingly

The insurance company are not interested in helping me, unless of course I use there in-house Solicitors or appointed Solicitors to deal with the personal injury claim in which turn they will get a kick back.

Any personal injury claim should be made to your insurers, but +12 months after the event, unless you stated in your origonal claim that PI was involved and you were waiting the outcome of medical reports its all water under the bridge as you accepted the origonal settlement.
