The Smoke-free (Private Vehicles) Regulations 2015

Regulation 2 provides for private vehicles to be smoke-free when they are enclosed, there is more than one person in the vehicle and a person under the age of 18 is present in the vehicle. Caravans and motor caravans are excluded when they are being used as living accommodation.

Regulation 3 ensures that there is no duty to display no-smoking signs in vehicles that are smoke-free by virtue of these Regulations.

Regulation 4 provides that a penalty notice may be given where there is reason to believe that a person has committed an offence of failing to prevent smoking in a vehicle that is smoke-free by virtue of these Regulations.

Regulation 5 sets the amount of the penalty for a penalty notice given in respect of an offence of failing to prevent smoking in a vehicle that is smoke-free by virtue of these Regulations.

Regulation 6 provides for chief officers of police to be enforcement authorities for vehicles that are smoke-free by virtue of these Regulations.

Long live the Nanny State! We are now so awash with petty regs. that a small army of jobsworths is needed to enforce them. A fine for having a fag in the wrong place.

Smoking regs lead to some of the stupidest situations. Rhosneigr station on Anglesey (and probably many others like it) has just an open-air platform, but as soon as you walk through the gate onto it smoking is banned. And (silliest of all) one is not allowed to smoke on the footplate of a steam engine as it is a workplace.

Section 2 of that Act defines smoking as:

"Part 1 — Smoking
Chapter 1 — Smoke-free premises, places and vehicles

(2) In this Chapter—
(a) “smoking” refers to smoking tobacco or anything which contains
tobacco, or smoking any other substance, and
(b) smoking includes being in possession of lit tobacco or of anything lit
which contains tobacco, or being in possession of any other lit
substance in a form in which it could be smoke.

Any other substance would appear to ban those lecky fags?

I am sure that whatever it is that is in in these vapping gadgets it is not actually burned m'lud-and moreover I have it on good authority that the substance is vaporised by raising the substance to such a temperature that is below the burning temperature- I rest my case.

One can only look at the reasoning for the ban which to me appears to be two fold.

Firstly to protect the nipper from passive smoke in a confined area.

Secondly to have the driver concentate on having full control while driving in that his hand is free from a ciggie and is not going up and down to his mouth for a gasp.

People have been fined have they not from eating at the wheel.

A test case will no doubt clarify.
