I am seeking advice about a used car I purchased on 30/01/15 for £2000 on debit card. The garage had told me that they have given it a service and it was ready to go. I asked when the cam belt had last been changed and 3 separate people who work at the garage assured me 100% it was a cam chain so didn't need doing. However on the morning of 02/02/15 my partner came to start the car and it made a strange noise. He stopped trying to start the engine immediately. He called the garage where we bought it from and explained what had happened which is 47.7 miles away. (we have only covered 97 miles total). They informed him that it would be covered under warranty but it was our responsibility to get it back to the garage. My partner contact his breakdown service which did not cover this as the would only take the vehicle to the nearest garage unless we upgraded. We took out further breakdown cover at an extra cost of £101.49 to have the vehicle recovered back to the garage where it was purchased from. On the 4th February the vehicle was inspected by the AA who advised us that the water was frozen in the engine (photo proof) it was then recovered back to the garage it was purchased from.

The garage received the vehicle and told my partner that the would slowly defrost the engine and inspect it. They apologised and said that it was one that slipped through the net and that we were not to worry as it is all covered under their warranty. The next day he received a call from them to say it was defrosted and they tried to start it and noticed that the timing was out so would be going into the garage. The mechanic found that the cam belt had failed due to a frozen engine. The mechanic proceeded to rectify the problem. A family member who lives near the garage went and asked the salesman what was happening. He left his contact details and explained that he lived 5 minutes away but we live over an hour away. I gave my permission for the garage to talk directly to my partners step f***her. Because I was led to believe that the garage would be fixing this for us I left it with them but asked for regular updates. We received a phone call 14/02/15 to inform us that all the work was completed and the vehicle was ready to be collected once I settled the balance. I asked what was meant by this and they informed me that I was to pay 50% of the overall bill which was £500. I told him that although I had signed that warranty I was under the impression that the garage would meet 100% costs under my consumer rights that the vehicle was not as described. I asked the salesman to confirm again that it had a service before being sold to us and he said yes. He then told me that he could not deal with my complaint and would have to wait for his f***her (owner of garage) to call me. I received a call off Ian around tea time the same day. He was very blunt and defensive towards me and asked me why I wasn't going to pay the bill. I explained all of the above to him and he told me that he never said that at point of sale and that he had only changed the oil and oil filter and that I should have known that. He then began to shout at me and talk over me whilst I was trying to explain my dilemma and consumer rights. He then shouted at me to come and pay £1000 and he'll see me in court. I feel very shaken by the whole experience and do not wish to have any further dealings with that man.

Can anyone point me in the right direction please?

Forgot to add that he also said that upon inspection there was antifreeze although a weeker mix and any car would have frozen in the temperatures it was exposed to in the hills. I have checked with the met office for those dates and the lowest was -5C. I'm not a mechanic or car expert but I think it should survive -5C?

Inform the garage that they can either give you the car back - FULLY repaired, and with you paying absolutely nothing, or they can give you a FULL refund. Any other outcome is unacceptable to you, and will result in you taking the garage to the small claims court.

Best to do it in writing - send it by email, but also a copy by post, recorded delivery. Inform them that ALL communication from now on is to be by email or post, as you feel there has been a 'breakdown in trust' over any verbal communications (it sounds a lot nicer than calling them a bunch of lying toerags).

Finally, I'd suggest you inform them of this thread, when you send the email, and send them a link to this thread too. That shows them that you are aware of your rights, and they risk all the attendant bad publicity if they screw it up any more.
