Peugeot 106 - Car accdent - lack of help from the police - Tamla

My friend was involved in an accdent where a car drove towards her on the wrong side of the road and only avoided injury or worse by swerving at the last moment, however her car was written off. The police took witness statements and took photos. However, she has been unable to get any of this information to claim her excess back and it would appear that this driver is not going to be prosecuted, and incredibly the other driver is alleging she drove at him! The Police simply will not help her at all, and she faces being sued by the other driver and also losing her no claims bonus through no fault of her own. Surely the police are obliged to give her the incident report? Any advice would be appreciated, she only has her state pension so can't afford legal advice.

Thank you

Go to the Police Station dealing ask to see Supervisory Officer and tell him you want the incident Number. Failure to dislose this then tell him you want to lodge a complaint against Police. At this time also try and find out what is happening re investigation.

It would appear that if they took statements (from whom - just the driver?) then they have started an investigation. The problem is it would seem from what said when they see the other driver he will make a counter claim against your bad driving.

Faced with a one against one allegation with no credible witnesses Plod will be unable to convince CPS to take a case of careless driving against either involved so down to Insutrance Co to sort out.

No help in this instance, but a dash cam would have made a massive difference to the probable outcome here, as it stands it's one persons word against the other, and don't be surprised if the other party enlist some shyster no win no fee parasite and some handy 'witnesses' just to cap it all.

The days of honour and honesty (in all spheres of life), where a man's or woman's word meant something, have but in a few cases gone forever as this country disappears quickly down the toilet, it's up to all of us to protect our own interests from now.

Those whom we put our faith in and thought we could rely on at one time, including official bodies from the top down, have proved themselves lacking, that's putting it as mildly as i can.
