i did a speed awareness course in may 2013,and i just been pulled for overtaking a learner driver,(i wasnt speeding as the learner was only doing 18mph) im being done for driving without reasonable consideration,would a course be offered or are the on the same time scale as speed awareness (3 yr)? or is it a different course?

It depends on your local police force area policy.

But you're far more likely to just be prosecuted and given points / fine.

You dont get done for driving withour consideration just for overtaking. Come on fess up, what really happened.

BTW penalties are the same for undue care and attention, 3-9 points and a fine that reflects you financial status. I am not aware of any course offered as an alternative but I may be wrong.

Definitely the inconsiderate learner at fault, why weren't they going lots faster?? It's your right to make ill considered ovetaking decisions, the other car must take some blame for wanting to turn, and the oncoming traffic shouldn't get away scot free.

When you go to court, just tell them the way it is. The learner will probably get locked up for the sheer nerve of holding you up.

The OP was trapped between the overtaking car in front of him and the learner, when the former, who shouldn't have overtaken at all, turned left.

The OP's mistake was was to follow the first overtaker, rather than wait and make his own, separate, decision about overtaking.

You are entitled to your opinion, I disagree with it.

The OP was impatient and made an ill judged decision, the fact that he will be up before the beak suggests that others agree.

It sounds very much like a follow the leader overtake - sat behind the learner for miles an oppurtunity came and the car infront overtook i followed - we had to get in because of oncoming traffic personally I like to have somewhere to go to when I overtake, not bank on a space appearing.

Maybe this is a lesson learnt. We don't know how well you know that road, but as well as the possibility of the car in front turning left (or right!), another car might join the road from either side. Collisions are always possible and your manoeuvre could have caused one.

When I get stuck behind slow traffic on a fairly quiet road I often look for a lay-by and wait a couple of minutes for it to get away. Much more relaxing, unless every last minute is important to you.

Ordovices isn't answering the original question, and as said above it does depend on the policy of the police force in the area where the incident happened. I've only ever heard of courses being offered for speeding, rather than driving without reasonable consideration: so I think it's likely to go to the magistrates' court.

I do have some sympathy, Hazzman: you were unlucky that a policeman saw it, unless there was actually a collision, which I assume there wasn't. All of us could easily do something like this, even the saintly Ordovices..

Try these: Hard cheese Mr Rapist, you got caught out by police work. Sorry Mr Burglar but you were caught red handed. It's unfortunate that the speed camera got you.

Why would any one be considered unlucky, because they were found to have committed an act which the authorities believe is worthy of following up.

All of us could easily do something like this

If you believe that you could easily do something like this, you should consider hanging your car keys up.

It's easy for any of us to roundly condemn the OP for his actions, but you made no attempt to answer his question. Even your initial reply didn't contain a single bit of useful information, just an attack on the OP.

Maybe you are perfect, never made a single mistake. Or maybe you're just a smug git who likes to point out other people's faults, while utterly failing to notice your own.

Who knows. But I'd be willing to hazard a guess as to which it is.

I didn't feel I needed to answer the question. You had already, so convincingly, made an answer up, though it doesn't appear to have any fact behind it - hence the "depends" and "far more likely"

I'm not perfect, I make mistakes and I would expect to be dealt with accordingly and proportionately (like having the anti terrorism squad abseil down and crash through my window for a frivolous comment about killing cats).

And yet, when you did make such a comment - and it was far from a 'frivolous' comment, as you NOW claim, and people roundly condemned you for it, you reacted as if you'd done nothing wrong, and were the wounded party.

Hazzman, I've just noticed that you're new to the forum, and I should have said 'welcome'. Most of us on here, with the odd exception (words chosen carefully!), are glad to help with advice and suggestions: that's what a forum is all about and it's why I can normally afford to be mild-mannered!

As I see it if there was a driver awareness course on offer I think the local fuzz would have made the offer. It appears to me that the two remaining alternatives are you will receive a fixed penalty notice with the appropriate fine and points or you will receive a summons to appear before the beak if the prosecution think the offence is serious enough that a fixed penalty is inappropriate. Suggest you wait for the postman and hope for the best.
