Fiat Punto - Hit by uninsured driver - Rob28

Hi,

My Fiat Punto was parked outside my uncle's house on the side of a quiet road, with other cars parked behind mine. Parking there was allowed and I parked sensibily with a decent gap between me and the car parked behind and handbrake on. Whilst away from my car, a driver in a Subaru hit my car head on at a high speed making an impact big enough to push my car backwards into the parked car behind. The driver of the Subaru immediately fled the scene and the car he was driving was uninsured. I'm making a claim with the Motor Insurers Bureau and have accepted that I may well recieve nothing in compensation.

But the other issue and reason why I'm posting here, is that recently I've heard that the owner of the car that was parked behind mine (my car was pushed into it hence causing damage to their car) has said they will try to claim against my insurance. As far as I'm aware, I did nothing wrong and their car was only damaged because someone hit my car with such a force that it pushed it back into theirs. So what I want to ask is: Does the owner of the car behind have any basis to make a claim against me?

Yes the other owner does have a claim against you, this claim is then added to your claim with the Bureau.

If the Subaru driver had been insured the claim against you would have been added to your claim against the Subaru.

The Bureau handles claims with uninsured drivers, all insurance Companies pay into its kitty and any claim will proceed in the same manner as if the driver had been insured, with same outcome.

Many policies now have an uninsured drivers promise. Should an uninsured driver hit you and you have proof who it was your car will be repaired with no effect on your NCB, next premium, no excess to pay etc.

Happened to dad. Hit by 14 year old and his mates. Followed car and immediately phoned police. They came and impounded the car and crushed it. Phoned his insurers next day and car was collected within the week. Dads premium actually went down at his renewal and the repairs cost him zero pounds.

He did look at going down the Bureau route originally to protect his NCB but there was a large excess to pay and a large chance he would have got nothing. Plus its not a quick process.

Absolute rubbish. The owner of the other car should claim off the Motor Insurance Bureau.

The law is Neligence and you cannot be held liable for something you were not neligent in doing.

Actually I don't think either of you stand a chance as the MIB will only pay out for personal injury not damage to property.

Very assertive but you're wrong about the MIB, they will pay for property damage in cases such as the posters.
