Volvo C30 - Volvo c30 broken from dealers - Volvobroken

I bought a 2010 volvo c30 with 37k miles 2 months ago and It has broken down. On top of this it won't even start. I've been reading up on my rights and i have compiled an email ready to send to the dealer incase they try to fob me off.

Is it the dealers responsibility to come and collect my vehicle?

Also what if the dealer proves that the goods were satisfactory at the time of sale? They signed my log book saying they serviced the car.

The consumer returns the goods in the first six months from the date of sale and requests a repair or replacement or a partial refund. In that case, the consumer does not have to prove the goods were faulty at the time of sale. It is assumed that they were. If the retailer does not agree, it is for the retailer to prove that the goods were satisfactory at the time of sale. This comes from Sale and Supply of Goods to Consumers Regulations 2002, derived from EU Directive 1999/44/EU which became Clauses 48A to 48F inclusive of the Sale of Goods act in April 2003

The dealer does not have to come and collect your car, you may have to either have it towed to them by your breakdown service (if you're a member of RAC/AA/Green Flag etc) or call them and detail what the problem is, and ask if they will recover it to their premises for inspection.

Did you buy from a Volvo main dealer or an independent?

From people's car www.peoplescar.co.uk/. I've already been towed to my home so would they furthur tow me back to the dealer? Also could i ask for a full refund? I've been looking over the car paper work and the same fault codes have occured for a previous owner. I don't want this to be an ongoing problem.

As you pointed out yourself, in your first post : the customer RETURNS the goods to the retailer ...

Nothing there that forces the retailer to collect the goods. It is YOUR responsibility to return them.

READ it ALL. Properly. No, go and read it ALL. Too many people read documents like that selectively. For example, page 11. Most people have a look at that, and automatically assume their rights last 6 years. If you read it properly, you'll see that that isn't the case at all.

You are kicking off about rejecting the car. What happens if it turns out to be a flat battery, caused by you leaving an internal light on ? If that's the case, then that's YOUR responsibility, and they can bill you for diagnosing and fixing the fault.

Lastly, another question for you. You've been looking through the paperwork, you say ... why now ? Why not BEFORE you put money on the table ?

I've had a quick read and it apperas the garage do need to collect the car.

"Any refund, repair or replacement you arrange with your customer relating to faulty goods must not cause them too much inconvenience and you will have to pay for other costs, for example, collection or delivery".

My car broke down with several faults of which im sure have nothing to do with me. I went to start the car to try and take it to a volvo garage but now fails to start. I did look over the paper work and the faults were taken care of. I'm pretty sure im within my rights to ask the garage to pay for the repairs due to the age of the car and how long i've owned it for. With regards to it not starting im going to figure out if its a flat battery or not and take it from there.

These are the faults from the AA breakdown recovery:

Those are serious faults, and not unknown with the C30. If as you say those fault codes had occurred for the previous owner, then the fault was indeed present at the time of sale.

You may not be able to reject the car straight away, you may have to give the dealer a chance to fix it - but you should have a strong case with the dealer.

The fault codes identified by the AA man are not all necessarily related to the same fault. Get the vehcile to the dealer and ask him to diagnose the problem. A word of caution with fault codes. A single real fault may bring on 5-10 faults as fault codes. The technican will need to clear these having recorded them before continuing. It is impossible to diagnose the faullts you are experiencing on your car on this website. Take the vehicle to where you brought it from and ask them to look at it for you and determine the cause of failure. At that point you have a discussion about "Pre existing fault" fair wear and tear etc... Its a little early to be wheeling out the "Right to reject" option when as others have said it could be a simple fault such as a bad earth

You may have to pay initially, but if the diagnostics show faults that were present before the car was sold you, then claim the diagnostic cost back.

I used to have s40 (basically same car). I had numerous electric glitches. I invested in a Volvo specific ppc diagnostic tool. It was very good and helped solve many problems without dealer visit. I got all the value back (and more) when I sold it too. Might be option if you keep car and get more issues. Volvo owners forum also helpful.
