Looking for some advice on rejecting a car.

Purchased a 22 month old vehicle from a large VW dealership recently. The dealership is not approved VW though. Car seemed fine when I looked at it and test drove it although I did mention an issue with the brakes before I purchased.

Around 2 weeks after purchase I had noticed a few issues with the car so booked it in to another VW dealership under the same franchise that was local to me. The car was taken in and they unearthed a few faults. Some I had noted and some that I hadn’t. They told me they couldn’t fix these though as the dealership I purchased from wanted the car back in to carry out the work on. It wasn’t exactly ideal for me as the dealership I purchased from is on the other side of the city to me but I done as they said and took it in to them.

On return I noted they had only fixed the issues the previous techs discovered and nothing that I had noted. Car had to back in again.

This time the car came back out with them telling me they couldn’t find anything wrong with the car. I had to point out to them the front brake pads were disintegrating and demanded they were fixed straight away. Car went back in next day and new front pads and discs were fitted. When I was checking the brakes I uncovered a serious amount of over spray on part of the car. This got me worried.

The car was then to be booked in for a rear end strip down and a number of other items to be repaired/replaced.

Since then I’ve found out the clutch is on its way out. There is a major fault with the suspension. (Possible broken spring or something along those lines). The car was a hire car and it was involved in at least one accident in the ownership of the hire company that owned it. It’s also the worst type of hire car possible. A city car type of affair with hundreds of different drivers doing who knows what to the car.

Nothing was mentioned at point of sale that the car was ex hire. I was never advised the car had been in an accident and the car was obviously sold as roadworthy.

I’ve now informed the dealership that I’m rejecting the car.

What should I do to keep myself right here?

A seller won't advise you of anything and is in no duty to. It is down to you as the buyer to ask the pertinent questions.

Is this car an ex hire car?
Has this car been in an accident?

You may get answers, but the seller may not know the answers. Any evasive answering is a sign to walk.

I was advised the car was a company car that had done motorway miles 32,000ish when i purchased

To me that is mis selling as if i had known the true provenance of the car then I'd never have bought it.

As for the overspray. I was advised prior to sale that the car had been through a full workshop check and there were no issues. Again I see this as mis selling. I'm trusting information being provided by the salesman and making a decision to purchase based on this.

Its just one thing after another and I'm done with it.

The cars been back to them on 4 different occasions plus once to another dealer and its still got a list of faults as long as your arm.

Finding out the true provenance of the car was the final straw. Well that and the fact the car needs a new clutch and some serious suspension work on top of everything else.

It's not clear to me how long you have owned this car. But as has been said above, you have to make a careful inspection and ask the right questions. The V5 (registration) document should show the previous owner, but unless the car was originally sold by the same dealer, they may not be able to tell you much.

'Company' car, 'hire' car, 'management' car - all will probably have been driven by people with little personal interest in taking care of them. Buy with caution.

Since the end of April.

Car was back in for faults within 2 weeks of purchase.

A company car is something completely different from a hire car.

I asked the right questions. Unfortunately the answers given were incorrect.

I believe (and I'll be happy to be corrected if I'm wrong) that these days car dealerships must inform you of all pertinent facts that would have an influence over your buying decision, whether you ask the questions or not. Here is a relevant document :

The Consumer Protection from Unfair Trading Regulations 2008 prohibits commercial practices that are unfair to consumers. If a trader misleads you or engages in an aggressive commercial practice and you make a decision to purchase a vehicle which you would not otherwise have done, the trader may be in breach of the regulations. For example, a trader may fail to inform you that the vehicle has previously been accident damaged or may claim it is 'sold as seen' to avoid their responsibilities to you.

If they have not told you that it was a hire car, then I'd say you've got a good chance of showing that they have indulged in those 'sharp practices'.

I think you'll struggle to reject it, they are fixing the problems, which to be honest don't sound serious to me.

It might have a broken spring, well its either broken or its not and presumably they change it if it is, the clutch might be failing, again is it or not...whats a rear end strip down, dismantle the rear brakes to check them over (which is proper service requirement for a mechanic) or are we removing the entire rear suspension cos its bent.

The mere fact its been a hire car is no different to it being a pool company car, any idiot will have driven it, a company car might have been issued to an idiot whos ragged it and held it on the clutch at every hill he encountered...its not just renters who periodically stick 50 litres of petrol in Diesel cars and its not just renters who abuse cars.

Backing up GB's remarks above, I worked for a large company 20 years ago, and occasionally drove a pool car, in this case a Pug 309. Nice car, but with only 16K on the clock I found the brake pads worn down to metal. Those cars can be so busy they have little chance of proper regular maintenance, and the stream of different users may not bother to report developing problems.

Bodywork and interior may be easily fettled up to look decent, but unless the selling dealer gives it a thorough check, they probably won't know of any problems. They may find it less trouble for buyers to discover them - they may not even come back to have them sorted!

I think GB was trying to say that your dealer was playing ball within the rules in trying to fix the faults. If you try to invoke SoGA they may choose to test that in court. There are many threads on this topic on here, from better experts than me.

So its not a VW dealership then. Its a simply a dealer that specialises in VW cars.

If they refuse the rejection, you will have to go to court. This is not that easy and takes time and costs money. Before you do so be aware that:

(a) You will have upfront court costs and will have to get a proper, independent, report on the car. You can't just turn up at court without some proper evidence of what is wrong with it.

(b) It will take a minimum of 8 months to get to a proper hearing in most areas.

(c) During that time you can't really use the car. Using a car for 8 months and x000 miles whilst at the same time arguing it isn't "fit for purpose" pretty much destroys your case so you will need to store the car and buy/rent another one for the period.

(d) The court will press you and the dealer to come to an amicable agreement beforehand. If you are determined to reject it and won't compromise that might not suit you.

(e) All this will obviously take time so be prepared for some days off work etc. attending inspections, court etc.

(f) There is a possibility you will lose the case at the end of all of this.

Basically, it is possible, but it won't be quick or easy if the dealer digs their heels in.
