Son received a letter from DVLA which said " you've been convicted 7/714 of an offence, send us your licence for endorsement".

It seems some felon was probably 'flashed' last January, was convicted of 'failing to identify driver' so fined £460 with 6pts at a London court.

My son has never been within 170 miles of London in his car, never received an NIOP, knows absolutely nothing about this and can prove he was nowhere near at the time of original offence.

We can only assume that somewhere along the line there has been an error, his name is not an uncommon one, presumably the original offender has the same name and date of birth and that is why DVLA have put thepoints on.

He's had this problem of someone with similar details before, can we trust DVLA to sort this, would it be better to write to the court, or does he need a solicitor?

Write to the Magistrates Clerk of the Court if you know which one explaining everything.

As you did not receive a summons and the first indication of a conviction was from Dvla they have the power to reopen the case and from what you state a NG plea will succeed providing you do this within 21 days of finding out from DVLA.

I would also consider reporting the matter to your local police regarding identity theft.

Further I would also write to DVLA again explaining all and that you have approached the convicting court/police

DVD, thank you very much for your advice, I had drafted a letter stating relevant facts to send to the Court, I will send a copy to DVLA and follow your suggestion of contacting local police re the (unlikely) possibility of identity theft. It seems more likely to be an error in the process than that a London offender knew the correct address and postcode of my stepson.

Checked the DVLA website today and the points have been removed from son's licence, so he's very happy! [Until I present my bill for legal services :-) ]

Son received a letter from DVLA today explaining that the true offender had two first names but Brent Magistrates' Court only saw fit to give DVLA one of these, which was the root cause of the problem.

So DVLA not at fault for once.
