Peugeot 504 - PCN.No sign not to park after 6.30pm single yellow - the.bloke

Hi All

I received a PCN last night at a spot where I park often to go to a cinema.

I never had any ticket at that spot before, being parked with other cars. I checked, as I always do before leaving the car, as new enforcement always turn up. Nothing visible. And no change when I came back.

Half of the pavement has double yellow. In the middle of it a board says "No parking". But nothing regarding the single yellow line. Now, I have checked the council cpz map for Wood Green. It has two zones, inner and outer.

The yellow line is around 50m long cut by a road [Vincent road]. 25m each side. At both end are yellow lines. But no sign to differentiate them, if you can or cannot park.

I was parked as usual where the red dot is. The green dot is where they say I could park. But the council map now says that it is part of the inner zone restricted to 10pm. Yet no sign to mention it.

The council says it has pics of the car. I have checked them, they are too dark to see anything but the shape of my car. You can also see the shape of other cars parked next to mine. [not clear too]. You can see them by inserting the PCN number and Reg of my car.

Now, depending where the officer stood to make the ticket, the satellite would give a total different reading, on the same yellow line. 5-7m make all the difference. Too easy.

Are there any point I could challenge the PCN? Thanks.

Well, the TRO you've posted only covers Lordship Lane up to the south western kerbline of St Albans Crescent, covers where the red dot is, so if you parked there then you're bang to rights. The TRO you have posted also has its description spelt wrong 'permises' instead of 'premises' but this will almost certainly be dismissed as de minimus under law as being of a trifling minimal nature to the obvious intended meaning.

Everything north east of this point, St Vincents Road onwards, where the green dot is, is not covered by this TRO so you cannot contravene this TRO if you were parked where the green dot is because you are not in the area covered by it.

However, if you were parked where the green dot is but on a single yellow then there must be a TRO that covers that single yellow, what does that say? If there is no single yellow or no applicable TRO then you are on a winner with regard the argument against the ticket, I would suggest.

With the use of googlemap, I took a pic showing the only Traffic Regulation Orders panel/board on that side of the street.

It covers from the zebra crossing of Albany road right to the top of Lordship Lane. [the red building]

As you can see, the panel/board is on a lamp post in the middle of the zigzag where you are not allowed to stop. How are you supposed to see that?

But any way, I was driving the other way.

I was parked after the first red bus in front of the building site. Now a gym.

The car was parked in front of the last large bay window on the left [3people standing]

I did not arrived from Albany/Vincent road.

But I drove into Lordship Lane from Redvers road and turned right and Parked. There are no sign on this road too.

I made a mistake with Vincent road. On the last pic, there is that road with no name, which I thought it was, but it seems to be a private road.

So, yes I now know it is a controlled zone until 10pm, but only if you drive from the entries of it. But there are no TRO panel to tell you that if you arrive from the middle, and no panel for the yellow line from the beginning of Lordship Lane up to the lamp post on the left on that side of the road.

So, how do I stand now?

Case, no case? Can I win this?

I believe that I never had any trouble until now because of this. [obviously, not the only one parked there]

Sorry, 504, judging on those photos you were parked within the TRO area as you were south west of the south western kerbline of St Albans Crescent.

If you turned right from Redvers Road then you were already in the controlled zone, judging by the council's map, so you must have already entered the zone and probably had already passed a sign to tell you that you were entering the zone. If you can find an entry road into the controlled zone that is not correctly signed as such then you may have a defence.

The only other crumb I can throw you is that the single yellow lines do not appear to be correctly painted in that they do not terminate with a T bar where they end in the private road so you may have a defence there; Pepipoo may the best bet for an answer on that.

The adjudicators have made clear that they won't allow appeals where the meaning of the lines is clear and the missing T bar a mere technicality.

One last point to clearify.

The officer took 4 pics of my car but none of them are clear. Blurry and too dark.
You can hardly see the number plate and definitively not where it could be.
A shadowy pic of my car.

They say it is a proof. To me it is no proof at all, unless you can clearly see my car in the street, on a yellow line.

Any thoughts on this?
