I got lost in a city centre last Sunday, found myself in a Bus Lane with no escape, was stopped by a bike mounted PCSO who told me I would be reported and should expect the issue of a fixed penalty notice. Fair enough but it hasn't arrived, yet. Is it subject to the 14 day rule applicable to NIPs for speeding offeces etc?

IMO - if you were stopped and gave satisfactory identification, there's no need for a NIP so the 14-day rule wouldn't apply - AFAIK they have 6 months to process this.

Thank you for your reply. I was not actually asked for identification -they must have noted my reg no, although I didn't see either of the two PCSOs writing! I understand you to say that, having given me a verbal statement that the matter would be reported, the Council or enforecement people have 6 months to issue the relevant charge notice?

Forget NOIP as this offence doesn't need it.

So your sure it was PSCO, not a CEO?

Did he take your name and address - doesn't seem so to me.

Did he issue you with a FPN - no apparently.Driver present should have done.

So he said you would reported. Worse scenarios he goes back to the Station and prepares a file for the offence, submits to CPS and they decide whether or not to issue a summons and a Court date. If so long wait. Must lay information in 6 months from date of offence otherwise limitation on proceedings kick in but if they do summons can be served outside 6 months

Back at t'office they raise from Reg No, if taken, a S172 name and shame sent to Reg Owner for driver details and a paper follow up. No time limit like a NOIP but too long and it doesn't help them.

or

if it twer LA offence detected on camera and a PCN sent through post. Time limit on this.

Cannot be absolutely certain you appreciate but I think you may have three greens and a safe landing with a scare from the PSCO. Will light a candle for you.

Thank you my learned and long-standing colleague! It was Reading and I was pursued down the bus lane by two PCSOs on push bikes. They didn't ask for any idetification, they must have taken the vehicle number. They didn't ask if I owned it etc. They may have said something about reporting the circumstances etc, they told me how to get out of the bus-lane (100 yards take the next left) and I went home.

I thought that bus lanes, parking etc were "minor" offences dealt with by the issue of a letter inviting the payment of a penaltly, with a discount for paying within 14 days? CPS sounds a bit OTT for something so relatively trivial and surely it can't get to court unless I choose to go there - appeal, dispute the circumstances etc?

A few years ago, also in Reading, I was fined for being in a bus lane for too long (in their view) before turning left. The fine came from the council so there was no question of points on my licence.

Bit more intel AS

As I suspected In October 2005 powers were introduced under the Transport Act 2000 that made it possible for Reading Borough Council to enforce the regulations governing the use of bus lanes in the Borough.

Whilst Police couldf still Act they tend to shun as LA have authority to deal with such and parking matters.

The fact that no personal details were taken means to me that you were in blue skies as far as Plod's hencemen are concerned.

BUT

The hun in the sun is a CCTV camera that may have zapped you and a letter with PCN from LA is on its way. Mein Gott...... Reg 20 of the SI 2007 No 3483 says they have up to 6 months to serve it. However I doubt a L:A would apply that length of time..

Other than last para above I think its still green vary light.

True, but they have the vehicle registration, or should have, so that will lead to me. presumabaly PCSOs witl pass info to Reading council, for admininstratiave action?

What a raw deal we really get, don't we? This happened to me the first time I went to Sheffield. I set the SatNav for my destination and followed the route. Then I received a little missive from the 'Peoples Republic of Sheffield' informing me they required a payment of £30 because apparantly I drove down a bus lane. It was raining and I must have assumed the SatNav would not take me down an unauthorised route. When I revisited I examined the spot and although it was a bus lane it was very confusing as to where it actually was and when it started and finished. I photographed the signs and the road and sent off an appeal. I pointed out that as a stranger to their fair city they could consider cutting me some slack on the proviso it never happened again. No such luck. Got a very dry and high toned letter pointing out my shortcomings as a driver and demanding payment forthwith. Welcome to Sheffield!!!!! What goes around comes around. I declined the opportunity to invest in a business there in order to expand and improve it. The business was half owned by Sheffield City Council. With my letter of declination I enclosed the correspondence they sent me and suggested they change their attitude toward strangers visiting their fair metropolis! needless to say, no response was received.
