Hi all hoping you can help me.

My wife returnd to her car lastnight to find a PCN atatched tothe car. The PCN says the charge is for parking beyond the markings witch she doesnt deny but says she was just on the line not over it.

What i want to ask is can parking atendants lift the windscreen of the car to put the ticket on the car and the photos they have taken are so bad you canot see any evedence of an infringment of the ruels.

First things first. What sort of PCN?

If it's a Parking Charge Notice issued by a landowner or his agent you could consider ignoring it - see advice on Pepipoo or Money Saving Expert. If it's a Penalty Charge Notice issued by or on behalf of the Council don't ignore it - it won't go away.

No reason why PA cannot slip the ticket under the wiper. Better than 'peelable' adhesive that sets like porridge,

If it's Council issued you'll need to decide quickly whether to accept and pay the discounted rate or to contest it and if the Council stick to their guns go to a Tribunal.

Assume restriction requires cars to be parked 'within' the markings. On them is not within and makes access/egress to next space difficult or impossible.

Any further discussion is futile until the OP comes back and confirms where the car was parked and who was resposnible for placing the ticket (invoice?) on the car.

Sorry about late reply, have been at work all day only just got in. It was a in a council car park. I have looked at the photos on line and they ate of such poor quality that you can't make out a anything in them. My wofe is adamant she was on the line amd not over it.

Sounds like a no ball....the line belongs to the umpire...in this case the council perhaps.

So looks like shell have to pay it. And maybe get some lessons in parking as she's never been very good at that.

My experience is that if you believe you have a valid case go for an appeal to the independent adjudicator. I got a ticket a year or so ago in a council car park and had a telephone review with the independent adjudicator and the council representative and won the case. Also last December I got a fixed penalty for being in a bus lane in Leeds. Again I made an appeal as I thought the signage was inadequate, and explained the reasons for my error . Leeds said yes, see your point and cancelled the fine, but said don't do it again!

That reads like something from an 'Allo, Allo' script. Predictive texting? ;>)

If the evidence is that poor, you may be better off copying it to the pepipoo website and getting their consensus.

If the markings were poor, you could try a polite letter to the council saying so. I did something similar in Twyford station car park last year - I wasn't aware that I wasn't in a 'designated area' and APCOA let me off.

Maybe worth trying an informal representation to the Council but don't lose your right to pay at the discounted rate.

Just to update we appealed the ticket after looking online at the councils parking regulations and wone the appeal as the offence happend outside of operating hours.
