Hi, recently i had my motorcycle stolen from my property, it was insured fully comp with AXA. All documents were sent, and a a brief questionnaire over the phone was carried out. All going well till i chased them up regarding the claim. I was told that i had not disclosed a claim back in 2011. I asked what the claim was as i had no recollection of a motor claim, and was told it was " a trampoline hit a neighbors car" this was correct, as a storm had blown the trampoline onto a neighbors car and damaged it. The claim was settled by our house insurance, as our car insurance wouldn't cover.

So when the question was asked, if i had and claims, accidents or losses or damages in the last 3 years, i took this as referring to Motor claims, not household claims....as the question never asked to disclose household claims...any help would be appreciated.

Very interesting. LIke most people I have had to claim in the past on my household policy, storm damage a couple of times and one occation when the wife set fire to the lounge carpet when she was taking the ashes out. I have never disclosed these when renewing mine or the wifes car insurance, never considered it to be relevant. Not even sure if the question from the insurers was specifically related to "motor claims" or just "claims".

The wife had one auto claim about 2 years after the carpet incident, sorted with no issues.

Maybe your claim was classed as an "auto" claim since the neighbours car was involved.

Will be interested to hear other feedback.

Maybe, but i need to prove that ive answered their questions honestly, in which i believe i have. My mindet when answering the questions was motor related, not household.

I presume you closed the claim down on your auto policy once they said they would not pay.

Buy why would you want to claim on your auto policy in the first place, your car was not involved in the incident between your trampoline and the neighbours car.

If you never started a claim through your car insurance and your home insurance paid the costs how could you inform them of previous auto claims, there were none.

But it all comes down to definitions.

I obvious that the insurer has picked upon the fact that the OP had a neighbour claim for damage to their car even though it was not paid by the OP's car insurance.

Does no declaration of that invalidate his bike insurance, no idea.

Does that mean you have to tell your car insurer about every insurance claim you make, lets hope not. Most garantees people take out are insurance policies of one type or another.

OTOH is it just a fact/question they've quoted - eg has the possible claim in 2011 now been settled?

If they're wriggling then complain and make clear that if necessary you'll go to the Ombudsman.

First of all, thanks for all your replies, the claim in 2011 was settled immediatel. They have yet to give me a decision regarding the bike claim, I had a brief conversation with the claim investigation team this morning, Who informed me about this issue, and he was informing the underwriters today. Bad enough having my pride and joy pinched,

It sounds like you rang your Car Insurer about the incident, they advised you it was not covered and they entered it as an incident on the Claims and Underwriting Exchange (CLUE).

I would ask the home Insurers for a covering letter confirming the incident was paid by them and giving a brief outline of the incident.

You can then send this to your motorcycle Insurers so they can see the issue.

I would also recommend you go back to your car insurers and explain the situation and forward them a copy of the letter. The initial level of customer services may try and palm you off as it will almost certainly be something they've never seen. If you remain polite and persist you should get through to someone who can help. Basically you want them to adjust the incident on CLUE to remove it.

If you have no luck with the car Insurers send a polite and concise letter headed "Official Complaint" along with a copy of the letter which should get them to remove the entry on CLUE.

Ideally you want the CLUE record cleared as it may cause other problems in the future.

You can obtain a copy of the data CLUE hold about you for a fee of £10.

The law changed recently regarding non disclosure so this should not affect your theft claim unless you have other claims or convictions.

Yes, our names were on the exchange due to them being associated with the neighbours claim. Had a call from my insurer telling me that because we used our house insurance, it would not affect our claim. Now just waiting for a valuation, my bike is not listed on any guide books....this could be interesting!

Looks like common sense has finally been applied.

Since its not in any guide books I suggest you start looking to see if there are any bikes of the same model/age for sale and use that price when you bargain.
