Toyota Yaris - Rejecting car to being repaired - welshstyles
Hi basically my car was involved in a accident which was not my fault last thursday..its a 2 month old toyota yaris hybrid t-spirit from what i can see it will need a new front bumper, headlight, wing also the fog light is smashed and alloy damaged with a chuck missing out of the tyre...the car is on finance with toyoyta also..they rang me today to say they will be repairing the car and i told them i do not want to car back because its a brand new car and im paying monthly for a new car not a damaged one and it will never be the same..they just said there is nothing you can do?. Is this right can i contest it? Because im peed off that im paying just shy of 270 a month for it

Any rights to reject the car are limited to manufacturing faults - not accident damage - I think you have no chance of avoiding the £270/month for the full period.

It would be no difference if the accident was minutes after you drove it away - it's not Toyota's fault!

In my experience Toyota approved repairers will restore the car to as-new standard. This is Toyota's policy so you should have no concerns.

As RT says, it's not Toyota's fault, so why should they allow you to reject the car?

I'm certain you have no legal come-back on this. You have my sympathy, but it's one of those things. As Galileo says, the repair will be pretty good anyway.

Make sure you get your excess back from the other drivers' insurance.

So because someone crashed into your car you think that you should be given a new one? Even though yours can be fixed.

No way is that going to happen - you just need to accept what happened and the car will be fixed roperly and i doubt you would ever know when it's been done.

From the dealer's/insurer's point of view, it is irrelevant whose fault it is that the car is damaged. If the accident was your fault, would you still expect a new car instead of a repair?

Reminds me of a tale my dad told about a dimwitted chap who bought a motorbike in the 1920s, crashed it, and took it back saying much the same thing. 'But it's broke!'.

Hardly the dealer's fault. Let them restore it to new condition and be grateful (presuming it's not been badly trashed).

A wing, bumper, headlight and wheel is nothing to get upset about, it hardly constitutes a big accident. These things happen. You have no chance of rejecting the car, that's just wishful thinking.

2) Trade-in repaired car

3) Drive away new car after having paid £3-5,000 for the privilege.

I have to agree with others. You are really taking the biscuit here. The accident was not fault Toyota's fault so do not blame me. You cannot make a claim under Sale of Goods Act - faulty, misdecribed,not fit for purpose - or consumer credit act.

Toyota have a great reputation. My wife had a Yaris. No issues or worries. So get real!

At least they have the integrity to issue a recall instead of denying there is a fault, unlike some makers deservedly complained about on this forum.

Fortunately things have moved on from then, and so must he.
