I had a case many years ago, was hit head on by a car (on my side of the road) the driver had borrowed from his mate. My car was repaired immediately by my insurers but I hit a brick wall trying to get my excess (and NCB) back. The cars insurers said the driver was not insured thus they would not pay, the drivers insurers said he was not insured to drive that car so they would not pay. Had no legal expense cover so paid the RAC (who did an uninsurred loss recovery service) to sort it. One solicitors letter and a cheque appeared, think it was from the cars insurers.
