I was sat in traffic in early August 2013 when a driver hit me in the back of my car. Caused about £1500 worth of damage. My insurers repaired the car. The other drivers insurer are not talking to my insurer. If you call to speak to them you are on hold for 20/30 minutes and no one picks up. They have not responded to letters from my insurer or my solicitor. Is this usual practice? I do not want a non fault accident logged against me, just because the other insurers are ignoring letters. Is there anything I can do to get them to respond.

Use the legal expense cover in your policy if you have it, and be patient - it took me 3 years to get back £400 when a truck clipped the back of our car.

Start a small claims court action against the other driver. This ought to get him to wake his insurer up.

Yes he has told them. My insurer told me Friday that even they cannot get through to his insure,r who are Zenith. I have contacted them via facebook, but they wont discuss with me "due to data protection". I am not prepared to wait 1 or 2 years for the claim to be settled. Unacceptable in my mind

Small claims costs a few quid and generally gets people to wake up. This is one disadvantage of you getting it sorted then expecting insurance companies to play ball. If possible get liability sorted before letting anyone touch your car.

Insurance Ombudsman? Surely they can intervene and give Zenith a kick up the backside to get them to respond to the correspondance sent to them?

Hello. The solicitors are being ignored also. I wont be waiting 3 years as I will either go to small claims or report the other insurer to the ombudsman. They would not wait 3 years for a premiuim to be paid. I know it is a slow process but it is going too slowly for me. Thanks for your input. Hopefully I can gee them up

Solicitors can use small claims on your behalf - doesn't necessarily make it quicker.

I had a case many years ago, was hit head on by a car (on my side of the road) the driver had borrowed from his mate. My car was repaired immediately by my insurers but I hit a brick wall trying to get my excess (and NCB) back. The cars insurers said the driver was not insured thus they would not pay, the drivers insurers said he was not insured to drive that car so they would not pay. Had no legal expense cover so paid the RAC (who did an uninsurred loss recovery service) to sort it. One solicitors letter and a cheque appeared, think it was from the cars insurers.

I have full legal protection but I am unable to speed things up. The other insurers have 3 months to "investigate" the claim. This will be up mid January. The solicitors have said I am unable to go to small claims at this stage due to the timescale involved. I have to sit and wait
