Any vehicle - My objections to new double yellow lines ignored - Supersnipe

In June 2013 a lamppost notice appeared announcing London Boro of Barnet plans to paint new double yellow lines at the junction of my road with another. I went to the offices and inspected the plans. Was advised to write in with my objections (Never heard of any accidents there in my 30+ years of residence, I am car & m/cycle IAM member therefore above average interest in road safety, seldom have I seen cars parked where lines proposed, far greater dangers exist at the junction for other reasons, lines unsightly and an unnecessary cost to ratepayers....etc etc.) I was assured that I would receive a reply advising of the Council's decision and the reasons therefor. Eventually did receive an `auto-response' acknowledgement of my letter, promising follow-up later. What happened 2 weeks ago?.........double yellow lines suddenly appear.

Can anyone advise how I should go about challenging and/or questioning the legality of this, please.

Why would you want to object to something that has been placed to make the rods safer, by your own admission you have an "above interest in road safety".

Since they are on your own road and you don't park in the area rejoice and enjoy the increased safety.

What does the OP think might make this decision liable to challenge.

The Council have given the required notice and, after considering his and any other comments, gone ahead with the proposal. Unless they've made some procedural mistake or the decision is one to which no rational council could have come then it's likley to be bombproof. If by some chance they've done it wrongly then Judicial Review might be sucessful but the likley outcome would be that Council went back to square one and did it right next time. JR would be pretty expensive too.

Otherwise, could you take it up with your ward councillor?

Many thanks Bromptonaut, very useful reply. I object to the needless extension of yellow lines which I see as motivated as revenue-increasing rather than road-safety (in this particular instance, at least). But thanks for the ward councillor suggestion - I will take it up..

In this particular instance I don't feel that the lines make the junction any safer at all and I suspect that the many other spots double yellow-lined under the same notice are more motivated by revenue-raising than safety. Near here there is a busy junction where there are double yellow lines, very sensibly placed so visibility is good, safe for pedestrians and road clear for turning traffic.

But because there is a PDSA clinic there, every day there are two or three cars parked on the double yellows, right up to the edge of the major A road, all displaying blue badges, while the owners have their dogs treated (free, because they're all on benefits) and are too lazy/obese to park 15 yards further away.

(Note that many are fit enough to stand outside smoking till called in so not that disabled) So traffic wardens ignore them, no revenue collected, safety not considered, waste of yellow paint.

I also don't understand your issue with this.

You say you seldom see cars parked where the lines are going, therefore you have some times seen cars parked there.

Yellow lines do not raise revenue, they allow people that park where parking isn't permitted to contribute to the council coffers.

Weasel words. By the same logic, speed cameras "allow people to contribute". There is no "allowing" about it - payment of a fine is mandatory.

The debate about which measures are really in the interests of safety and which are intended mainly or solely to increase revenue is still very much alive.

In my local town a while back, yellow lines were painted on side roads with few or any driveways and where I cannot believe safety or congestion was an issue. The only explanation seemed to be that the locations are an easy walk from the shops and the council wanted more cars in the (paying) car parks.

I don't see that we can comment on the OP's objections, without precise details of the road layout, traffic flows and so on.

Going off topic but if people park on double yellow lines or break speed limits they should pay a fine.

You may see the laws as intruding into you life but if you don't break them you don't get fined, simples.

I would also like to know what the relationship between being a member of the IAM is to having an above average interest in safety?

Do I have to join if I want to be more concerned about my family's safety?

Says it all, BARNET council, who are waging an unrelenting war on motorists, Is this not the council who were stopped from using "parking revenue" from residents parking permits to cross subsidise other "projects"

Got 1 ticket once in edgeware where i failed to understand the multiple choice signs, which craftily included a controlled zone sign at the entrance to the road, gleefully pointed out by the warden when i asked why the ticket. Now so difficult to park simply do NOT shop in Edgeware or Barnet any more, and I am sure there are plenty on this forum who can see how the main shopping street has disintegrated.

If the council make it too hard to park legally, and I thought I had parked legally, but paid the fine, and wrote and informed them that i would shop elsewhere.

Do they care?
