Nissan Navara D22 - failed crankshaft after only 12000 miles - jabba1

I have a recon engine by a fer member, the crankshaft has failed and the engineer also a fer member has stated a manufacturing fault, i have spoken to the rebuild company and they have washed their hands of it. As far as i'm concerned this falls under the sales of goods act , as the shaft was not fit for purpose/ i'm the unlucky 1 in 1000 its happened to. their is no other contributer to the failer but with the fer member dening any responsibility for the supplied new crankshaft i have costs running into 1000s what should i do.

The FER member did not supply a new crankshaft, or did he? It was a reon engine which implies a lot of old parts and maybe some new ones, SFAIK Did the name of the supplier have any connection with Heathrow BTW? http://www.honestjohn.co.uk/forum/post/index.htm?t=51565

the member has informed that crankshaft conrods bearings and pistons are fitted as new on all engines reconed by them selves. I must quote that their is no other damage in the engine or clutch/ gearbox at all only the failed crank, The fer member is not connected with heathrow , but is probably the uk's largest engine supplier when i rang again they all knew about my problem so it was obviously a discussion point they were then very quick to blame other factors and insist i pay for them to recon my engine again, infact my engineer said it was poor workman ship with regards to the whole build quality but thats straying away from the crank snapping and a bad casting

You havn't stated how long you have had this recon engine. Do you have service receipts.

If you can prove the engine has been serviced correctly the only way forward will be through the small claims court. But you will need an engineers report from a reputable engineer which will be costly. All your costs will be re-imbursed as long as you win the case.

I presume that the engine was actually a remanufactured engine (rebuilt with new internals) rather than reconditioned (which has no legal definition) because you mention the supplier being a member of FER the Federation of Engine Remanufacturers.

If so, then you can contact the FER and ask them to adjudicate.

i am still waiting for a reply from fer, the engine was serviced regually by a garage the last full service being 500 miles pre failure, the engine is being repaired by another fer member who is going to issue a report for all works. for legal reasons i won't name the re manufacterer but they are a big company.
