Fiesta R reg - Small collision - now claiming whiplash. - MrSilverNeedle

OK, so i had a small collision with someone the other day (saturday 15th June). I went into the back of her, if smashed my headlight and there was no damage to her vechicle. She requested that nothing was done through insurance, which i said was fine and that i would cover the damage done to my car.

Now i have received contact from my insurance (aviva) about an 'alledged road traffic accident'.

I spoke to my insurance and asked that they clarify what was going on, and was informed that the person was claiming for whiplash through a solicitor or what have you. I said that i would get back to him tomorrow and we'd discuss the matter

I didn't take down any details of this person.

I'm really not sure what to do now, if there's any information that i've left out please let me know. I'm not a medical professional but I'm doubting that she received whiplash from the collision that occured.

thanks

Lots of people have accidents and later change their view of what happened.

You should have got all details. You say there was no damage to the other person's car. If I may say so, that is an extremely naive statement. There may have been no damage apparent to you, but you should assume nothing.

Also, in view of the high number of false whiplash claims, fuelled by dodgy legal outfits, you could more or less assume the other person would try it on, so you need as many details of what happened as possible. Having said that, your insurance will of course cover you.

All you can do now is to present your story as clearly as possible.

Yes it is naive - the whole set up is. My acceptance of another person is pretty naive really if we're being frank.

But there wasn't damage - nothing visable at least. I got out the car, we both looked and couldn't find anything on her's, so in light of that i think that saying 'there was no damage' is fairly reasonable.

What i was undure about is whether i should press for any sort of proof in regards to these claim's and to what extent i should. Or whether I should just accept a loss and go on with things.

It is not your role to deal with the other party's claims. You are not being sued and you are not likely to be.

Leave it to your insurance company.
