Toyota Liteace - Scraped a car, owner said he would get quotes..... - panda-selecta

Last week i hit a 2007 Audi at a petrol station which resulted in a scrape on the front wing of the Audi. After exchanging details with the owner of the Audi (during which time he offered to 'lay me out') he said he would get some quotes for the work needed and call me as claiming through insurance would mean i couldn't afford the increase (needed for work).

This morning i got in the post a letter asking for my insurance details as the owner of the Audi is claiming instead for....

1: Repairs/pre-accident market value

2: Hire/loss of use

3: Possible loss of earnings

4: Special damages

Where do i stand regarding this, as a claim will mean i can't afford to run my van and i will have to give up my job.

Is it at all possible to just pay out of my own money?

I may be missing the point here! Either pay it yourself but haggle the amount, or use the insurance you pay for to settle the claim for you

Trying to pay the amount myself, as its nothing that a chipsaway guy couldn't sort (scrape with no dents on the wing). But the other party seems determined to go through the insurance. I guess what i want to know is if i can make him repair it at my expense instead of claiming?

Hi ,yours is an interesting post .

Clearly you caused the damage to his car and your responsible for the damage ,not your insurer .I don't believe your obliged to instruct your insurer . You would then be liable to pay for the damage to the other car .

As you have admitted liability ,your obliged to return the claimants car to the condition it was in before it was damaged and for genuine expenses that he may incur while his cars out of action .

If you really want to make it an issue ,tell the claimant you will not involve your insurance company and you will only pay a reasonable amount for the repair .

However the claimant could have his car repaired by his own insurer , who could then pursue you through the courts for the cost of repairs .

Finally you must inform your insurance company what you intend to do ,you could invalidate your insurance if you don't .

Opting to pay yourself works as long as you are dealing with somebody who's happy to just have their car fixed and is prepared to be reasonable about it.

As he is obviously not the sort who's likely to be reasonable about anything, you are going to have to go through your insurers. If you start down the road of paying his ficticious list of expenses yourself, he will take you to the cleaners.

That'll be the Credit hire scam. That's going to be expensive. Easily more than the cost of the repair itself and with no insurer fighting your corner to force him to mitigate his expenses, he may well opt for a couple of weeks in a nice, new Audi A8 here.

That translates as "if you're daft enough to go the off book route, I'm evil enough to stick you with a whiplash claim.".

This is excellent advice. You have been incredibly unfortunate to have a scrape with someone who appears, to be polite, somewhat unbalanced. There are too many pitfalls to dealing with it on your own. I would contact your insurance company as soon as possible. The extra costs involved with them will at least be, hopefully, manageable. This 'gentleman' appears intent in making it the equivalent of a small lottery win. Sorry to be downbeat about it but I don't feel there's much choice for your peace of mind.

Also to put a smile on my face is the fact his car insurance next year will go up as he has had an accident even if its not his fault but that serves him right for being a prat.

Mine went up the same as a lady hit me from behind and accepted the liability, pity she wanted to go through insurance as it cost us both extra

Surely, unless he has gone somewhere and deliberately stoved in the side of his car, any claim for injury would be dismissed by an insurer as total b******* if the only damage is a scratch on the paintwork?! Even with the insurance industry being as thoroughly septic as it currently is, how could anybody accept an injury worth compo could result from that?
