Friend/colleague is in a quandry regarding an insurance claim:

October 2024 she was reversing out of her driveway, paused at the edge of the pavement looking both ways for traffic, wheels just into the road (for context, residential road in the suburbs, two car widths wide). She is then hit from behind by the neighbour opposite reversing out of his driveway at the same time. At some pace according to my friend. Both parties get out of their cars, friend says How did you not see me? Neighbour says My sensors didn't go off.

Friend subsequently contacted her insurance company who agreed to repair which were completed in November. New tailgate and rear bumper.

March 6th this year, she's contacted by her insurance company, saying We need more information, any footage (none), fill out a form and complete a diagram, which she does

Two weeks later, she's contacted by her insurer's solicitors saying the the third party is now denying responsibility and urging her to accept 50/50 or go to court and risk losing at considerable cost.

My reaction was go to court but she's terrified despite feeling strongly she's in the right.

Any suggestions please.

Just send all the correspondence to your friend's insurer and let them sort it out - they are the ones who might have to pay out.

I'd suggest that if your friend has no evidence that they were stationary at the time of impact, then it looks like 'knock for knock' to me.

On that basis I would suggest it is up to the third party to prove the opposite. Till then it is one word against another ?

Aren't you supposed to reverse into your drive, so you can then drive out frontwards into the traffic?

I and two others in our road reverse in, the rest go in forwards, apart from the dozen who can't be bothered to put their car in the drive and leave it on the road.
