Passenger Seat not adjusting. is it a MOT Failure? - ITLiterateMark

My daughter has a two door Citroen DS3 where the passenger seat moves forwards and backwards but it doesn't adjust up or down. The mechanism is broken.

It no great hardship at the moment however the MOT is coming up and I'm concerned weather this is an MOT failure?

As I understand it as long as the seat is secure it'll pass, not sure a mot inspector cares if it can be adjusted or not.

If you mean that it cannot be folded etc to allow people to exit the rear that could be a failure since it would be potentially hazardous in an emergency.

On a 2 door car , the backrest needs to fold and lock in the upright position. If it doesn’t, it’ll be a failure.

Would removing the rear seats for the test get round the problem if the seat back does not fold?

Odd question I know but why does the OP not get the seat repaired or replaced by a working one from a breakers?

Surely its not that hard to sort.

Does it have a seat height adjustment? The passenger seat in my Yaris doesn't.

I'm currently looking for a replacement. plenty on ebay, it's just getting the right one for the vehicle.

I've looked at the .Gov website for MOTS, the passenger seat is in a secure upright position, the structure is not defective.

As long as the MOT person knows his stuff it should pass.

DefectCategory(a) A passenger seat:

(i) with a defective structure or the backrest cannot be retained in the upright position
(ii) insecure
