Hi,

My parked car was recently hit by a hit and run driver. The other partys insurance company has admitted responsibility as there is CCTV of the incident.

The car is a low value car, but ive spend thousands on it to make it the best version of itself.

The downside to this is that being its a low value car im being told by everyone my car will be a write off meaning its value is reduced significantly and my future insurance costs will increase even though none of this was my fault.

It has body damage and some front left suspension damage.

The second part is that even I somehow manage to avoid the write off, im being told I will get a Category S or N, which will also reduce the cars value and potentially increase insurance costs.

My questions is is there any way to to avoid my car being written off and/or being given a category.

Im pretty sure I can pursuade the insurance company the car is not a write off as the cost of repairs and parts is quite low, but I really want to avoid a category altogether.

Could I potentially fix some of the damage to the suspension myself first before making a claim, or will this affect my ability to claim in future?

All this seems really unfair given it was parked at the time and Im having to pay for it many times over.

Whether your car is written off will be determined by how your (or the third party's) insurer's estimation of the cost to buy a car near-identical to yours, compares with their estimate of ithe full repair of your car. If the damage is cosmetic rather than structural, repair may be possible, and a local bodyshop may estimate a bit less than the insurer.

If the insurer writes off, you may accept the write-off value or keep the car, take a reduced payout and pay for your own repair. Either way, the car will receive a Cat flag on the DVLA record.

If the Alfa is not deemed a write off by insurers it will not receive a category flag.

So, the situation is this.

The car was sent down to copart who assessed the vehicle and told me it was a "Write off" and will be given a category.

I challenged this as well as their valuation of the car. This was then sent to an insurance handler who called and said weve seen pictures of your car and believe it has been modified, the repercussions of which are that the underwriters may cancel the insurance and not pay out anything as they deem the car to be uninsured.

The repercussions of all this are:

1. The car may be written off

2. The car may receive a category

3. My insurance may be cancelled

All of which will have a huge impact on the saleability of the car and my insurance premiums.

The only way I can see to stop all the above happening is to withdraw the claim, cancel the insurance ( before the underwriters do ), to avoid the write off and any chance of my policy being voided. Then chase the other insurance company for the costs of repair.

I have cancelled my policy this week, so presumably the claim will be null and void as they cant legally cancel my insurance as its already cancelled by me, and the car wont be written off or receive a category as I didnt proceed with the claim?

The other insurance company has admitted liability, my only concern is that they'll try to write it off too. The only thing I can think of to try to negate this as much as possible is to at least get the suspension fixed before I make a claim from the other insurance company to reduce the costs of repair and avoid the write off.. is this advisable/at all possible? And are there any legal implications of doing this If I part repair my car before making a claim in order to avoid a write off or a category?

If you have cancelled the insurance, you now need to SORN the car and take it off the road.

To be honest, I don't think that was the best move. Perhaps consider withdrawing the claim, but don't cancel the whole policy.

Your insurer is being difficult as they can't guarantee that whatever offer they make to you will be honoured by the third party's insurer. You need to be negotiating with the third party's insurer. If they think your repairs are going to cost less than they will have to pay out on a write off, they might agree to settle.

In that case, the car wouldn't be written off and wouldn't end up as a Cat S or N. Given that the car is at least 14 years old, I wouldn't worry too much about the effect that would have on value in any case. All of the value is to you, not 'the market'.

The going advice online is to cancel your insurance BEFORE they do, if you sense it may be cancelled by them. If they cancel it you have to declare it for years to come and it will affect your premiums for years. So thats why I cancelled it FIRST.

I bought the car as it is, but they are saying its been modified which on closer inspection it may have been, and it was my responsibility to make sure it was factory standard before getting insured, so im taking no risks.

Just concerned my insurance company has already put a mark/category on it. Can I simply ask them to remove it if I didnt proceed with the claim?

I'm guessing that's what making it 'the best version of itself' means. Otherwise, we're talking about a lot of cleaning products.
