Hyundai - Mis-sold car package - Bobby567

I recently bought a Hyundai and was reading through my warranty a couple of days ago. It states I get one free health check a year whilst the car is under warranty. The dealership (a Hyundai dealership) I bought the car from sold me a customer care package which include 2 free health checks a year.

They clearly would have known this was not needed and therefore mis-sold. They have been a complete nightmare to deal with from the get go, adding tax twice for the car, not being knowledgeable regarding functions in the car, letting me drive away without dust caps on tyres and the salesman who sold me the car communication was awful.

I think they are going to fob me off when I bring this to their attention. Does anyone know if I have any rights regarding being mis-sold this customer care package?

Thank you

For a brief moment I thought Hyundai had a special arrangement with the NHS, but I soon realised the health check must be for the car ...

There might be a 14 day cooling off period on the contract.

Have a look at the paperwork.

If there is send a Recorded Delivery Letter highlighting the paragraph + you keep a copy of the letter.

This could be the answer.

I have a 5 year Service Agreement, bought when the car was new, which says it can be cancelled in the first 14 days for a full refund BUT after that time the contract stands and goes to the 2nd owner should I sell the car.

How much was the contract? If over £100 you might have a case with the Finance/CC company.

Did you pay anything by Credit Card at the time of sale or say a holding deposit - If so the CC Company can give you a refund and charge back the dealer.

It was just a day over the 14 day cooling off period. It was £99 and paid via debit card. I'll check paperwork as I might have 30 days to cancel this policy.

Thanks for taking time to reply

An essential annual service should be all you need to keep the car healthy. If you paid £99 solely for two "free" health checks you wasted your money anyway. Assuming the package includes more than that, the existence of another "free" health check is not grounds for a mis-selling claim

Whay year is the car, mileage, Under warranty ? Hyundai warranty or dealer warranty?

If hyundai warranty as an approved used vehicle ask for a refund of the £99 from the dealer as they are selling something you don't need and let Hyundai know.

I'm not a legal expert, but you may have rights under the Consumer Rights Act 2015. Start by contacting the dealership to address the issue, and if needed.

Only if you paid over £100 of the price with a Credit Card.

Not a Debit Card.

Always make sure you do the above, the dealers can't refuse, and it puts the onus on the C/Card company to take any action - much less stress!

Dealers can refuse to accept a credit card - they can't charge more to accept one.
