Ford Focus - HPI CHECK FAILED - saints2012

Hello, Just hoping someone could advise me if I have case against the HPI company.

In December 2021, I bought a used car from a dealer for £30,000 and before purchasing the vehicle I paid to have a HPI check to make sure everything was clear on the vehicle. It came back clear and made refrence to not being a write off.

Fast forward to last week and i have attempted to list my vehicle on carwow, though they declined my request claiming my vehicle had previously been salavaged. Following a number of checks i discovered my vehicle had been stolen recovered and thei nsurance company had paid out on the vehicle and it was later sold by auction on a breakers website..

Do i have a case against the HPI company for not showing the relevant information and ultimately I bought a vehicle I would have never touched i had known it was an insurance write off?

Yes i did everything i was asked from the HPI company. I am also dealing with the seller under the Consumer act and they are taking the vehicle back and should be giving me the going rate for a vehicle that's not been written off.

In the past when peoples have complained to HPI, the reply has been the info was correct at the time of the check.

But as has been said, any claim is against the dealer, but his HPI check was likely valid when he checked.

The true HPI company does offer indemnity if you pay the correct fee for the cover but I suspect that even this has get outs. Look at any salvage company and on some cars they will advertise as "" clear when checked "" so a marker can appear later when the insurance gets around to it Presumably a £30k car was bought from a reputable dealer so ultimately the fall back should be on them to check their stock. Did you purchase the HPI check yourself? £30K for a second hand Focus sounds a bit steep even for these times?

Hello, It's a Focus RS.

The dealer also went off their own HPI check that showed the vehicle had no warning markers ( they claim ) and so they bought the vehicle. I did my own HPI check because regardless of what i am told by a dealer I want to make sure.

Though it seems a clear cut case of the HPI cjeck failing, lifes never that easy, Having previously had an HPI check fail but unable to claim due ro the company going bust this time i went with a big compsny if you like.

I am just hoping someone might have been through the same and could confirm what i am emtitled to from the HPI company?

I know my rights with the dealer and it should be straight forward with the HPI company but i just know it wont be,

I cannot think that they will both pay up and you do not know if the same HPI company was used or how thorough the checks. The best you may hope for is the company takes the car back and compensates you in some way although they will claim you have had use of the car. Or you could elect to keep the car and the dealer refunds you an agreed price price difference usually 20-25% of the retail price when you bought it. He may still claim money back for your use of the car. The car company would have the come back on its HPI co. i would guess
