Hi all,

I'm looking at buying a used car from a dealership, and I asked if they had done an HPI check on the car. They said that they had, but were not able to share the results with me due to data protection rules under GDPR. Is that correct? I can't see why HPI should be affected by data privacy considering that I could easily just pay for a check myself and get access to the same data anyway. Could they perhaps be trying to hide something from me?

Why not just do the check yourself? Or get them in writing that they confirm it as HPI clear and if not they will reimburse you for any loss.

Oh yeah I absolutely will do another HPI check myself. Just trying to get a sense of whether this should be a red flag that the dealership is dishonest, or if they genuinely believe that they are not legally allowed to show me the HPI report.

I’m going to take a guess that the dealer has paid for an HPI check for their use only, in that they don’t have clearance to pass on any data to a third party - I.E you.
When you pay for an HPI, you won’t be able to share the data with anyone else.

Yes, they're talking nonsense. GDPR covers personal data. HPI reports don't contain personal data.

Yes they are talking rubbish, do it yourself or go somewhere else. If there was personal info they could hide the surname and address and copy it to you but there is not personal info so they are talking garbage.

Adampr , absolutely correct mate. It's only details that could enable personal identification or medical records etc.

Not one thing to be found in an HPI report.

I'm no expert on GDPR but I handle personal data in my job so it's something I have to think about.

Legitimate Interest looks like a good defence for them if they were challenged.

A clear HPI check would be a good selling point, so if he won't show it there is a reason, walking away should be your response.

It is frustrating but I'm not sure if there's anything more we can do. Avant raised it in one of the Sticky threads eleven years ago this very month. I think some people may assume they get an email alert when a reply is made but we don't have that functionaility.

Its lack of updates or even the odd thanks that is helping so many forums to die off, this is an old fashioned place in many ways (despite it being inhabited by so many lefties :-) ) and many knowledgeable posters who gave real expert advice have disappeared over time, one such was a long time mechanic who really knew his stuff, so many times he would give freely of his expertise quite likely saving the poster £hundreds and invaluable time only for the OP to completely ignore him afterwards, it annoyed the hell out of me let alone said mechanic...sadly basic manners are vanishing everywhere, they say a fish rots from the head down.
