Today I pulled up at a red traffic light near Wigston fire station. A fire engine then came out with all lights flashing. Initially I did not move but the car behind was gesturing me to go and then the fire engine sounded it’s horn. At that point I moved forward and I am unsure whether the light was still on red as I was being careful to watch for traffic. The camera did not flash I think. If I receive a ticket would this be classed as mitigating circumstances as I feel I was bullied in to moving? Also what are the risks of going for mitigation?

By all means go for mitigation but in this crazy country of late even the bleeding obvious is no get out of jail as others will testify

The law is clear - you cannot cross against red unless instructed to do so by a police officer in uniform. The fire appliance driver will know this.

So in principle you should have waited, although you took what you believed was a sensible and helpful course of action. Wait to see if you get a ticket - and then use the wise heads on pepipoo to help you if one arrives.

I'll save you the trouble.

The wise heads on Pepipoo will tell you (in the event that you do get a ticket) that in order to put forward any mitigation you will have to decline any out of court offers which may be made (either a course - no points and a fee of a little under £100, or a fixed penalty - £100 and three points) and instead opt for court proceedings. There you will face an income related fine, a Victim Surcharge of 10% of the fine (minimum £34), £85 costs and three points.

You could ask the ticket office to consider the matter though they probably won't. They prefer to let the courts settle such things. You could also gamble on the court finding "Special Reasons" not to endorse your licence and impose points and perhaps impose an absolute discharge. If they don't they will not impose a penalty lower than the fixed penalty and more probably, in total, quite a bit higher.

I don't think that going past a red light when an emergency vehicle is using the crossing simply because you felt bullied is much of a defence.

If you get a fine pay up and think yourself lucky nothing worse happened.

I have been stopped and told off for not obstructing a box junction, Luckily they saw sense.

IF you are told to move and pass ared light by a policeman, that is your defence,

otherwise, it is up to the emergency vehicle to make their own way safely past.

Too late now of course but I have always followed a good piece of advice my driving instructor gave when I was learning years ago. When in a queue of cars, always leave a decent space between you and the car in front so you have room to move over should you need to. Also do the same when at the head of a queue at traffic lights, so you've got room to get out of the way without crossing the line. It may not be possible in some cases but it will help.

As the 'offence' only occurred on Monday it's obviously far too early to know if you were caught by the camera or whether proceedings will follow.

The purpose of red light cameras is to catch people who run the light in the second or so after it goes red. If you've stopped and then crossed the line that may be insufficient to trigger it. It's also possible that the movement to allow the appliance to pass was not sufficient to trigger the sensors.

The problem the OP will face is that if it does result in action he will almost certainly see the matter referred to court. The police make their decision on course/fixed penalty/court based on the "time into red". Usually more than about four seconds beyond red will see no out-of-court disposal offered.


But as you say, lots of "ifs" at the moment.

Is the OP sure that there is a camera system in operation? In streetview there was none to be seen.

Sensible legislation from a California police department manual: "No person shall fail or refuse to comply with or to perform any act forbidden by any lawful order, signal, or direction of a traffic or police officer, or a member of the fire department, or a person authorized by the chief of police or by law."
It strikes me as perfectly reasonable to make changes in legislation to allow for a firefighter (all of them perhaps?) to be trained/permitted to direct traffic in emergency situations. A fire officer in high viz uniform can perfectly easily jump out of the cab to direct one car through a red light when the danger to human lives is weighed against a traffic light signal.
How many of us would prefer to sit self-righteously in a car at a red light holding up a fire engine knowing that a family may be burning to death a few streets away?
