Evening, a young 17 yr old reversed x 4 into my car on an uphill and cracked my bumper. Despite having dashcam footage of the incident. He is claiming that the noise in the car from his three passengers and music was so loud that he didn't hear the impact and drove off. So in his head he isn't liable. He's saying that he rolled into me four times.

I have footage of his driving prior to this event and to say he was reckless would be an understatement to which the police agreed. The police also have ANPR footage of him driving around the area at speed and carelessly.

My insurers have sorted everything out and my damaged bumper and grill have been fixed. The police were offering a community resolution as my premium will doubt go up despite having "no claims protected". But despite this he say that he wasn't aware that he reversed into me!

So now I have to go to court? Despite dashcam evidence. Despite him admitting that he was driving at the time. I also have a witness to his reversing into me.

This young man had only passed his test 3 days prior (through the Army) yet thought this driving was acceptable.

I'm not pee'd off at anything other than this kid thinks that what he did was okay. Plus, now I have to go to court and I feel like the criminal!

s*** happens. When I was 17 and idiot mate of mine passed his test one afternoon and by 5 pm had written off his mothers car when he lost control and rolled into a car park. By pure luck the car he hit belonged to his fathers business partner.

Last saw him about 30 years ago. Still an idiot. Written off plenty more cars, driven several restaurants his father bought him into bankruptcy, paying child support to a legion of "ladies".

Nothing was ever his fault.

The police clearly know it was the other driver's fault, so you'd only be a witness and only if they are going to prosecute. So no need to feel like a criminal, or to worry about what's in his head (not much, and he won't last long in the Army).

If they aren't going to prosecute, then the only thing you'll need to do is to negotiate with your insurer about your NCD. They should be sympathetic but you may need to shop around come renewal time.

Decisions in the past by HIgh Court has been that if person is not aware of contact then it is a get out from charge of failing to stop, Yourself and dash cam evidence can negate this defence. Are you aware if he has been reported for this offence and possible due care?

He is therefore admitting driving without due care, you have that in writing or text message?

If Police are not taking action then its Small Claims court for you were you claim any costs associated, eg increase in insurance cost for you

I'm not clear why you need to go to court.

Is it a civil case about reclaiming the cost of fettling your car or are you a witness in a magistrates (or worst case Crown Court) case over his offending?

Either way there's no reason to feel like a criminal unless you're in the dock. Civil cases at this level are often dealt with around a table rather than in court. The vast majority settle without a hearing; the escalation of costs once the clerk has got up and said " Smith v Jones for hearing" focus the mind wonderfully.

If it's a Criminal Case there's plenty to read on line or via witness support scemes if you're really disturbed.

I was hit up the back by a MB 300 series which had been hit by an MB A Class Hire car. The A class driver had signed for the hire as using her own insurance and declining to pay extra for Insurance cover.

2 years on, on the eve of a court case, she admitted it was her fault. My solicitor thinks she had cold feet re - Perjury

Full payment agreed within an hour of the 3rd party changing her story - I was paid £4000+ for personal injury, £1,000 car damage, Lawyer bill, medical consultant, court fees etc

Try & get settlement. Court works BUT it can take ages.

What could have been settled quickly escalated and the insurer paid out a lot more than if they had just paid out immediately - my lawyer's bill alone was more than the car damage repair.
