My wife has been caught speeding 58 in a 40 zone by camera! The Notice of intention to prosecute was sent to her company with a request for driver information.

She shown it her friend at a law firm who said the notice was over 14 days and therefore it may mean there's a chance it could be voided so the law firm on her behalf sent a letter to the Central Ticket Office manager explaining this as per standard template letter asking for the matter to be dropped.

Since then I have looked at the online portal detail given on the letter which states the first letter was sent within the 14 days which may of gone to the lease company and then the second letter which is 28 days later was sent.

Obviously seems that thats it shes caught which is fine but they have not given the name of the driver within the 28 day period? Should we do this immediately even though we've had no response? She's very worried now that by trying to get off the offence she will get fined further for not providing the information ! Any help greatly appreciated.

It sounds like the law firm isn't very good at their job if they didn't check the facts first.

They have said the letter is a Notice of intention to prosecute sent late so await for the ticket manager to prove they have sent an earlier letter then respond. There is nowhere online to change the driver from the company name. Maybe just await a response.

58 in a 40 is a bit excessive, I would expect the company HR to take a dim view.

I do not agree with exploiting loopholes to avoid a penalty (or awareness course) if there is no valid mitigation factor.

There have been many high profile cases of MPs and celebrities doing this because

a ) they can afford expensive lawyers and b) they think they are above the laws applying to everyone else.

Looks like the first letter went to the Registered Keeper, probably the leasing company. That's the only one that has to satisfy the 14 day rule.

Leasing company nominated the employer, correctly.

Employer nominated your wife, correctly.

If she fails to respond unequivocally in the time limit from having the notice served on her she is looking at a big fine and six points - and very expensive insurance. She needs to nominate herself straight away.

If she does this in good time ther is a chance she'll be offered a speed awareness course and no points; if she delays there will not be the offer and it'll be fixed penalty and points.

Speed offence within 14 days NOIP to driver (if known) or Reg Keeper.

If the later onus on REg Keeper to name driver wuithin 28 days Offence not to do so.

Once driver details known they send NOIP this can be outside 14 daysrule.

If she has a responsible enough position in her company to lease a VW Touareg, assuming that she definitely was the driver and admits that she was breaking the limit, surely the best course of action is to admit it and pay the fine.

She won't be able to do a Speed Awareness Course for 58 in a 40 limit. 53 would be the maximum for a course.
