Cleggy - a case to answer.

Having some trouble understanding this. The car was sold with a 3mth warranty which suggests it was over 3yrs old at time of purchase. Indeed, the questioner says it was purchased with an MOT.

Isn't emissions part of the MOT test? If the DPF had been cut in half and internals removed, should the car have passed an MOT?

It may well have been something that was overlooked on the MOT, but questioner had been driving the car for 6mth / 8000miles without error.

If this were taken to court, I'd expect the garage to say the car was legal at the time of sale, (using MOT as evidence?) suggesting the DPF was tampered with afterwards.

It's unfortuate, but I just don't see how the questioner could win his/her case. Besides, six months from purchse, doesn't the onus fall on the purchaser to prove the fault existed? How is he/she going to do that?

Ignis crash: Good luck with that. You will probably get nowhere as the third party will argue that the repair should have been done properly and the vehicle put back to original condition by the repairers. If not then it should be written off and the vehicle replaced under the policy as it's in the first year of registration with first owner (most not all policies do this). However, the damage does not sound serious enough to write the vehicle off so the repair should be sound. If he still cannot live with the memory then swap the car. I doubt any claim for perceived loss of value on an already depreciating value could be calculated.

The number of times I have read the same excrement re putting a DSG in IDLE while stationary, to prevent failure of the trouble-fated DQ200 gearbox, is proper b*****, simple because this is the way I have always driven and our DQ200 FAILED!, regardless!

Suzuki Ignis : Diminution is generally only successful on prestige and exotic cars of high value. You will find it impossible to find a law firm who are prepared to take on a claim for diminution on a car that would only cost £10,000 to purchase new, although I understand your frustrations that you value your car the same if not more than someone who drives a £60,000 Porsche.
