Just had a look over it. No wonder lawyers get paid so much - no-one but them understands this mumbo-jumbo! Haven't they heard of 'plain English'?

Most of it seems to pertain to how the bill is to be set up and very little on rules as to how parking enforcement is to be run, unless I'm looking at the wrong document.

It requires the Secretary of State for Transport to prepare a Code of Practice for approval by both Houses of Parliament and to amend it from time to time.

Casting the code in stone in the Act itself would probably not be a good thing - too difficult to sort out bugs or amend it as circumstances change.

I think the sting for the Parking Industry is in para 5 where non-compliance with the code can have consequences for ability to get keeper details from DVLA.

The section on appeals may also sting the industry. Slightly surprised there's no provision for involvement of the Lord Chancellor in appointment to an appeals system.

I'd also be concerned about level of priority the SoS will give to a Code of Practice and the capacity of the Parking Industry to tie him in knots whether during the consultation or via other 'Lobbying'.

Para 5 is a rehash of what already exists. Very few suspensions now, so that won't change.

Any suspensions are temporary and there are suspicions the companies have previously harvested the data and applied after the ban.

I'm sure the scammers will ignore everything and carry on as normal.

Never mind lawyers, I'm an engineer and get documents from prospective customers outlining their requirements for a new piece of machinery. These are referred to as a URS, (user requirement specification).

I can honestly tell you, that in 90% of cases, the URS will be 99 pages of contractual crap and one page of what the machine has to actually do. The bit I'm interested in is usually no more than one or two paragraphs..................... it's pathetic, but it does keep a lot of very well paid (but ultimately un-knowledgeable) customers staff employed! Basically they don't know what they want, but they know I do (and how to manufacture it).

I think Bromptonaut touched on something with 'lobbying'. They must have some effective lobbying system when you see what they got in the so called 'Protection of Freedoms Act'. A licence to do virtually as they please, relying on ignorance and unwillingness to take them on. Also to pursue potentially innocent vehicle keepers for breaches of contract by other people. I know what I would do with them given the opportunity, but this is a family forum......

How do you stop commuters or folks who live down the road freeloading respectively on shop car parks or spaces provided for occupants of residential flats?

Well Bromptonaut and Gibbo. You make very fair points and I agree with them. The situations you mention are the ones that need parking enforcement and I would expect the people whose parking is being abused to have systems in place to protect their rights. But I don't connect that with the basic principle of innocent unless proven guilty. In effect it is down to some money grubbing commercial organisation, whose revenue depends on 'fines', to decide what happens. I am not in favour of that.

I repeat I am not in favour of wholesale free and abandoned parking anywhere. The parking is organised to be used properly for the benefit of all. Which means the vast majority use the facilities wisely and with consideration for others. The few that don't end up on forums bleating about being victimised. Each case on it's merits and not a one size fits all approach with the commercial companies in charge of policy. Is that clear now?

Several times parking companies have attempted to extort money from me under false pretences and they have always failed. Why? I hear you cry. They have been wrong, that is why. And I have the courage and resources to defend myself. Using previously expressed logic I am either guilty because they say I am or I am a m**** for not understanding some of the deliberately complex procedures for parking. Neither of which is the case i can assure of that too. Just a little more circumspection within the system concerning this subject is all I ask. Not a lot really.

Ignorance is no excuse. We can't pick and choose which signs to ignore in the highway code. Same applies to free parking elsewhere.

I'm sick of these idiots who go running to the paper because they "didn't see the sign" in the car park. The signs which are on every pole or lamp post in the place.

Even when signs appear after you have parked, or are moved around, or only appear in 'evidence' packs', all of these have happened,

I tried to use a private car park earlier this week. I still have no idea how you were supposed to pay. There was no barrier, but the machine would not take cash until you were ready to leave.

It looked like it was down to me to note the times I entered and left and pay what I thought was the correct amount. Needless to say they didn't get my money as this is another system which has seen massive issues and lots of revenue generated for the unscrupulous operators.

My statement was that people are ignorant of the process to defend themselves against these companies or do not have the resources or resolve to do so. Why do you think the invoices they issue mimic a real PCN? You may be surprised at how many people take them for the real thing. Coincidence? I don't think so. Ignorance is no excuse for breaking the law or any reasonable contract. But no one should be persecuted for a 'fine' because they lack the ability to defend themselves, through ignorance or otherwise. It is called a caring society.

Alright Gibbo, I respect your opinion. I will disagree though. Some poor souls are too timid to even contemplate taking on what they see as authority, I am quite prepared to do a bit of 'hand holding' to help someone through a legal/civil quagmire. If ignorance was a crime I suspect we all, at some point would have served time! As a famous man once said
