Hope someone can offer some advice to at least calm me down. Around three weeks ago I was got out of bed around 11pm to allow a police officer to look at my car. 2 weeks earlier a Volvo had reversed into another car while the owner was away from it and a shop keeper had MISTAKENLY given my registration. The police were satisfied it was nothing to do with me, my car isn't a Volvo. They have subsequently looked at CCTV, found the driver who has admitted it and I was told to forget it. This week my insurance email me to say my insurance is about to be voided because I didn't report an accident to them. It also included the fact the man ho owns the bumped car has lodged a personal injury claim against me. Making note he wasn't near his car at the time it was bumped!

My insurance tell me they are duty bound to treat me like this. The police won't help because they did their part.

My issue is, these are strangers dragging me into this, I need my car I drive for my work, how much trouble, ringing form filling, explaining and hassle is reasonable? I have been stressed out over this for weeks.

I suggest you write a clear, concise time line of every event. Dates, times, places, names.

Then email the insurers with this information. Then follow it with a phone call to the complaints department. Dig your heels in very firmly.

Yes there will be hassle but look at it from the company's perspective. They have what they believe is a claim against you, which as far as they knew you hadn't reported. So with the information they had, they deduced that you had broken your contract with them. Therefore you need to explain firmly, unequivocally and unemotionally (yes I know it'll be tough) just what the facts of the matter are.

Thanks for that. I actually did that, rang, explained gave all the contacts for the police officer dealing with it, including his collar number and email. I shouldn't actually know the correct number plate involved, but I was told it so gave that too. The man whose car was bumped has made absolutely no effort to inform his insurance that he is wrong and that this has nothing to do with me. I understand and accept that he gave information as he had it, but he was told immediately he was wrong the next day and he's made absolutely no effort to sort it out. This is his problem, not mine at the end of the day!

Let the first party (who wrote down the wrong reg) know what's happening to you and that you will be submitting a claim for any losses and trouble incurred due to their mistake. Make it clear that if your insurance is voided you'll be travelling everywhere by taxi.

I hate to go down the US route of suing everyone in sight for every little thing, but hitting people in their pockets is the only way to get action sometimes.

I must confess to being absolutely and utterly furious! I thought standing on my drive late at night with the neighbours looking at a cop and his mag light was enough hassle for one person. This man has his own issues, they aren't mine. He's told my insurance he was hurtin this bump but has made a statement to the police that he was nowhere near his car at the time, cctv confirms this too. I don't know who this man is nor can I contact him. I realise it's irrational but I am literally losing sleep over this, I have not a jot to do with it and here I am answering questions and being asked if I can provide any proof of where I actually was at the time. I'm getting furious, it's my business where I was cctv confirms I wasn't reversing into this liar's car. ( I was at Aldi as it goes, 30 miles away!)

I'm somewhat surprised if as you say Police visited at 11pm for what was a minor damage only accident, that doesnt sound right.

Dont phone your insurers or at least become involved in any back and forth

Write to the Insurers, Complaints Dept, use recorded delivery, make it clear that this is a fraudulent claim, and that you will hold them directly resonsible for any damage/financial loss suffered

I'm surprised that the insurance company didn't do some simple checks on the so-called claim, like looking the registration number up to see if it tallied with the make of car alleged to have done the damage?

Absolutely spot-on. In my own experience (from 2009), they show little concern for fighting your case when you have been involved in a no-fault claim too?

They gave me the impression they would just pay-out (but make sure I suffered years of increased premiums)?

Are you sure that Email was genuine? I'd have thought that an insurance company would write to you in a case like this on official letterhead. Hover over the Email in your mailbox and check. It could be some form of scam.
