I’ve recently been involved in an incident where A dog ran out in front of my car and I hit it. The dog was injured but not seriously, so it had to be treated at the vets. I am not at fault, however the dogs owner is trying to go through my car insurance to pay for vet bills. I have a lot going on in my life at the moment so I don’t have time to deal with any insurance claims, and the dog owner has agreed that if I pay £60 he will drop the claim. I was wondering if I paid the £60 whether there would be anything stopping him from taking it further and carrying on with the claim? Even if I had proof of the transaction and proof of his messages saying that he would accept the money.

As I understand it, if the dog ran out then whoever was with it wasn't in control of it and is liable for damage to your car and their own vets bill.

Yup, dog loose so if owner responsible, not you.

Of course in the real world dogs get loose, they spot a cat or rabbit and even if on a lead they take off at such a rate that they can easily catch their owner unawares, and the dog gets hurt, just one of those things its what doggies do.

Its rich this chancer trying to get you to pay the vets bills for the dog, i think your insurer would tell them to take a hike (unless they have a reasonable case you were driving recklessly or somehow endangered the dog) , and they know this too so hoping you'll bung them £60, unpleasant people.

I think that if he signed a statement saying amount was accepted as full and final settlement then it'd be an uphill struggle to re-open claim. But then again if he said something new had come to light and dogamundo needed ongoing treatment it might be more difficult.

In spite of the hassle factor I'd suggest getting your insurer to deal. Last couple of times I've claimed it's been pretty straightforward. One call to report and a couple of follow ups in case where I was 'no fault' and loose ends of claim like car hire (I just got one from Hertz for time car was in bodyshop) needed to be quantified.

My understanding is that the police should have been involved, either at the time of the accident or within 24 hours; whether it's now too late to inform them I have no idea.

Only in very rare cases, if it can be established that the driver was at fault, is the driver liable for vet bills etc. If the dog was not under anyone's control it's difficult to see how the driver could be responsible.

Personally, in the case described above, I would not offer a penny and let the dog's owner make the next move. Even if there is "a lot going on in my life at the moment" any repercussions would involve minimal involvement by yourself - filling in a form, maybe.

If you go down the route proposed by the dog owner you will have to draw up a statement for him to sign, carefully worded to ensure he is agreeing not to pursue the claim any further. Frankly, I think this is more hassle than the alternative.

There is no mention of the dog owner in the legislation.

Road Traffic Act 1988, Section 170:

"(6) To comply with a duty under this section to report an accident or to produce such a certificate of insurance or security, or other evidence, as is mentioned in section 165(2)(a) of this Act, the driver—

(a) must do so at a police station or to a constable, and

(b) must do so as soon as is reasonably practicable and, in any case, within twenty-four hours of the occurrence of the accident.”

Duty to report only applies if details were not exchanged at time. If driver has complied with 170(2) then no need to report.

Duty to show insurance etc to police only applies under 170(1)(a) - injury to a person and again only if production not dealt with at time.
