Hello!

My partner and I have paid a deposit on a used car and agreed a price on a part exchange for our existing car. We have a Car Sales Invoice which contains the details of both cars and the agreed price. A day before going to complete the exchange the guy at the garage called to say that his boss doesn't want to do the part exchange any more. Can the garage do this? We went for a part exchange as the MOT was about to expire and we didn't want the extra expense and hassle of selling it ourselves. Is the Sales Invoice legally binding at all? We're currently waiting a call back from the boss of the garage to discuss but he's taking his time...

Any advice appreciated!

The garage/dealer can cancel the sale but on the details given they would be in breech of contract and you would be entitled to a full refund of any deposite and any consequential loss sustained whils you source another car.

Howver any dealer who actis in this way is likely to ignore any complaints, so unless Trading Standards get involved you are unlikely to get anywhere other than having any deposit returned

You’ll probably find something in the small print that lets them wriggle out. Even if there isn’t they’re clearly dodgy and likely to be a fly by night outfit that would bankrupt their current trading name before paying a penny to you. Buy elsewhere even if it does end up costing a bit more as the car they’re selling is likely dodgy too.
