My 2006 Toyota Yaris has been called in for a safety bag replacement.

I got the driver side airbag done about 6 months ago, at a local dealers. Now I have received a letter for the passenger side airbag.

Is it legally mandatory to get this work done? Last time I was hanging about at the dealers for half a day, while they tried to sell me a new car!

Let's face it, the car is 12 yrs old, with minimal resale value. And the passenger seat is rarely used!

The chances of anything dangerous happening are pretty miniscule, I would guess.

Normally they'll let you have a courtesy car if you pre arrange the appointment, and no i wouldn't be interested in anything new they have to sell from the present ugly as sin line up.

Secondly, apart from the safety aspect (and the implications for you should a passenger be seriously injured or killed if you refused the work are serious indeed) if the airbag fails and turns the airbag light on the the car is probably an economic write off, so why not get this job carried out.

Most Toyota dealers will give the car the once over while its there, yes they're looking for work but it's never a hardship letting a dealer tech cast his mincers about.

The dealer didn't offer me a courtesy car, and there was no staff available to give me a lift home. So I was stuck on an industrial estate for half a day.

But you haven't really answered my question. Is such a recall legally mandatory?

I refused the recall to swap the alloy wheels for different size on my Hilux, Toyota had cocked up on the european Invincible models and fitted the wrong size tyres, smaller size than rest of the world equivalent models, id already cured the inherant instability long before the recall because i'd swapped the OE tyres before they had covered 1000 miles and fitted the correct size...quite why Toyota didn't do the blindingly obvious and cheaper cure is a mystery indeed.

Anyway, they requested i sign off refusal to perform recall, which i was happy to do, still can't answer you in legal terms, but they will probably require a written refusal which presumably will absolve them of litigation should something happen involving many £££ in injury claims, remember as in my case this could have implications with you re your insurer should anything happen, nothing did happen, helped by the vehicle being infinitely more stable and driveable on the correct size tyres.

I was in the same position as the OP with my previous car.

1. Taking it in would involve a dealer fifteen miles away.

2. I didn't want the dahboard dismantled as it was rattle free and didn't know what it would be like after they'd had it apart.

3. It was the front passenger airbag and as I was usually driving it alone, I felt it was a risk worth taking.

I sold the car and left it up to the new owner to decide.

I've just had my 4-year-old Yaris have an airbag recall that I had done at the same time as a service. They offered a courtesy car, but the small print included a £1250 excess. I wasn't going to get into a 'that damage wasn't there before' argument, so got a bus home. They managed to remove my GB plate, presumably with a pressure washer during the 'free' valet. I didn't notice until SWMBO pointed it out.

Are you serious. There is a potential safety issue with your car and you ask if you should get it fixed. Toyota are being honest about the issue and will sort it free of charge, other than the minor inconvenience of going to one of their dealers, not exactly rare are they.

If they said nothing and a person in your car was injured you would be on here wanting to know what action you could take against them and how much money you would get in compensation.

Some people are simply unbelievable.

Given Sod's Law and the number of incompetent/drugged/drunk/texting drivers around the probability is much higher than if your car was the only one on the roads.

First car I bought with an airbag was a 1996 Golf, 22 years ago and in normal circumstances I would not expect to see one go off.

But why risk it when Toyota are offering a free repair.

Just imagine the outcry on here if a few airbags went off on other brands and the manufacturers ignored the fact.

Risk assessment involves probability AND consequence. What happens if the airbag either fails to operate or goes off spontaeously?

Low probability but dire consequence scores high; mitigating action required.

As far as I’m aware it’s not a legal obligation for you to have it carried out though it is in the pipeline to make checking that any safety recalls have been acted on part of the Mot so st some point it’ll fail because you haven’t had it done. Currently it’s law that dealers must not sell on a car with any outstanding safety recalls.

Of more concern is your insurance however as they have recently been checking these recalls on cars involved in accidents and refusing injury claims they can link to the inaction of the owner, even refusing claims in their entirety because brake, suspension or other safety related recalls haven’t been carried out.

I wouldn’t risk it. Just have it done for peace of mind and you can relax knowing that a faulty airbag isn’t going to hurt you or a passenger.

Ref the Airbag Recall the reason this and about 50 million other cars are being recall is because if the car was involved in an accident and the airbag goes off parts of the casing can come out as well which will hit you in the face. So the answer to your question is if you are not worried about this then don't have it replaced but most people would want this replaced very quickly.

There have been about 20 deaths around the world with this problem so best just get this done asap.

No its not madatory on your part.

However if there is a problem relating to the a/b that results in an insurance claim then your insureres would not cover you.
