Hello, hoping for some advice. I was driving in central lane on a one way. Someone pulled into middle lane from a concealed side road into middle lane(ass closest lane to their entrance had parked cars along it) I was doing 30, saw the person pulling into my lane and braked to avoid collision, plus swerved to avoid the crash, but couldn't swerve left as there was a car to my right, instead serving right and we collided. I hit my passenger front side at 45degree angle into her rear. She entered the road into my right of way, couldn't have seen the flow of traffic was coming, and I'm sure it was on her. She admitted fault at the scene and also pulled out of a driveway that was entry only. Am I in the right or is she? Many thanks

Doesn't matter what we say or think, only your (and the other) insurance companies will decide where liability lies.

In addition, I'm sure the other party's viewpoint on exactly what happened will not be identical to yours.

She can change her mind BUT coming out of an "entry only" increases your chances greatly.

Crash Cam installed in your car would have been a "good buy". but hindsight is wonderful !

The decision will go down to evidence. Pulling from a side road into a main road and hitting a car is generally the other drivers problem, however in order to make this stick you will need to show why the other person is 100% at fault.

You therefore need a good statement - photos, diagrams with measurements, speeds, distances, time of day, weather etc etc and quote the highway code sections dealing with entering a road from a side road and state how the other driver fell below the required standard and it lead to the accident.

It will take some time, but you are in for increased premiums if the insurance companies decide on 50:50 for an easy life!

In my own limited experience, this is EXACTLY what the insurance companies do in such cases. Over time if they all take this approach for all minor accidents the costs even themselves out for the insurance companies and to hell with the poor sods who were at no fault whatsoever.

I was hit by a Polish HGV sevearl years ago and it took me forever to get my insurance company to admit that it was a "no fault" claim on my policy. Their attitude was "we are repairing your car without charging you an excess, what are you moaning about...."

It does my head-in.
