I bought a new x3 on 10 March 2011. I also bought the five year service pack and had the car serviced at a BMW dealer after two and four years. (2 year intervals for diesel)

All went well unti 24 March 2016, the car was then 5 years 2 weeks old and had done a tiny 13k miles.

On that day, I got several error messages on the dashboard and put it into my local BMW dealer to be checked. I was advised that the DDE unit had to be replaced together with a wheel sensor. The dealer could not give an explanation why the units failed. The bill was GBP1,832 and the car was out of action for 6 days.

I have approached BMW UK for compensation and their response was:

The car was out of warranty

You did not take out extended warranty

We cannot guarantee the life of any part failing (not the best grammar)

Sorry but we are unable to assist you with your request.

Any comments or advice please?

Unfortunately I don't think you have a very strong case. The dealer could perhaps make a goodwill claim if they agree that the part should have lasted longer (sorry, I don't know what DDE is - I can only think of Dwight David Eisenhower!).

BMW are likely to take the view that 13,000 miles in five years (presumably mainly at 40 mph max on Jersey) is just as hard on a car as 113,000 would have been - perhaps more so.

It would be interesting to know why you bought a diesel.

Thanks, the DDE is the engine management computer.

I bought the car as I had intended using it in Switzerland each winter, but my circumstances changed shortly after I bought the car and I sold my Swiss property.

I would say that driving in Jersey is similar to city driving in the UK. Overall I average 18 mph.

It's likely that Jersey consumer law is different to UK law. But in UK your redress is against the seller of the goods, not the manufacturer; I imagine it's the same for you. And after that length of time, it's very unlikely that the seller can be held responsible for breakdowns.

It's hugely unlucky that the car decided to break down so soon after the warranty (effectively an insurance policy) expired. There's not much hope in getting an insurer to pay out for a loss after the policy expires!

That only leaves you with BMW's goodwill. They have a commercial decision to make here - will paying a contribution to your repair costs be of any benefit to them? Sometimes a payment can gain good publicity for the brand; sometimes it'll encourage a series of other claims which may vary from the reasonable to the wildly implausible, all of which will cost time and money to deal with; sometimes a payment may deflect bad publicity. But it's a commercial judgement, and their response may depend on how the request is pitched and whether the BMW dealership are willing to be supportive (and that, of course, is another commercial decision!)

The 5 year service pack is completely different to the warranty, and completely irrelevant. The warranty on BMWs is 3 years.

As another poster has pointed out, you effectively gambled. Would the cost of the extended warranty be less than the cost of any failures ?

I'm in a similar position myself now. My BMWs warranty is coming up to expiry at 3 years old, and I have to make a choice. Do I

1. Take out extended warranty with BMW

2. Take out extended warranty with other provider

3. Hope that nothing breaks, and if it does, I'll be able to get decent 'goodwill'

4. Stick my head in the sand.

It appears you chose option 3 or 4.

Do the garage give any indication that it is actually the DDE unit at fault? More likely that it is showing a fault in some component elsewhere, surely? Faced with the old nonsense of throwing parts at the engine, I suggest a second opinion, and a check of fault codes.

ECU's can be repaired, there are several places who could undertake the testing and if necessary the repair of the unit, i've had two Merc ECU's repaired sucessfully over the years with a saving of around £1200 on each unit.

BBA Reman is one that gets good feedback, has even impressed my MB indy, which is impressive in itself, i used a company on the Isle of Wight both times for mine, this was before i or he had heard of BBA.

The better repair shops will test the unit fully and if its not faulty won't fix it, obviously, and a very reasonable charge will be imposed for testing and carriage, but beware there are poor repair shops out there too as i found out, so be careful where the unit gets sent if this option is explored.

edit, just realised they've fixed it with a new unit @ £££, if i was you i'd ask for the old one back with a view to flogging it on via a certain online auction site, but i have a suspicion it will already have been 'disposed of'.

I hope you'll let us know which option you eventually choose, Rob. I would have come up against this one later in the year, but because of SWMBO's problems getting in and out, I've gone for option 5 out of your 4 - get a new car.

I will need to find out from Volvo how much extra it's likely to cost if you take out an extended warranty after three years as opposed to doing it up front (the latter being fine if you know you're going to keep it for more than three years).

Having spent a bit of time in the trade and seen a few "scares" and reading the "exclusions"... (They've all got them!)

I consider any aftermarket warranty to be so much expensive toilet paper,

Would only go for an extended manufacturers warranty.

Personally I now get rid of cars after warranty expires and don't buy any extensions.

I realise that not everyone can do this, but a car is now "white goods" with a finite service life and with modern electronics a potential minefield.

And what if water gets into the lovely ecu, not covered..

I have used them a few times and generally found them quite good. I used to use BBA but they messed up a climate control unit of mine and I had a heck of a job getting a refund out of them. Was one issue out of several succesful ones so probably a one-off and I would consider BBA again but I decided to just try someone else.

ACtronics are Dutch company and quite big. Most of the repairs seem to get done in the UK but some specialist stuff I think gets over nighted to The Netherlands and over nighted back the next day.

With all these sorts of repair companies I'd look for (a) warranty and (b) what their refund policy is if the repair doesn't work.
