Hi everyone,

Looking for a bit of advice as I'm new in the country- I moved over in Jan on a trial basis at work.

I was visiting in Ireland over the weekend and came home last night to a smashed up car outside my house when I returned. Completely written off while it was parked. There was a note from the police saying they had the details of the accident.

Have been trying to get in touch to find out what happened, is other car insured etc but the station told me the only one with the details of the incident is the officer who attended the scene and she's off for a week!! So I have no idea where I stand until then.

My car is Irish Reg and I only have 3rd party insurance so they won't do anything for me. I was told I needed to be resident 6 months before I could trade my license in for a UK one and the insurance quotes I was getting with my Irish license were crazy! So planned to take my car for the first few months and then sort myself out with a UK car then.

Now I have no car for 3 months- I can't buy another UK one as I can't pay the insurance with an Irish license and I can't have another Irish car bought and shipped over for only 3 months!

I have also been told it is unlikely that the other car is insured and if this is the case I will get nothing. Surely this can't be right? Completely not at fault and yet am left without a car and have to foot the entire bill myself? Is there nothing more that can be done in these situations?

I have a young daughter so walking everywhere is not really an option.

I know I have to wait ans see what the officer tell me, but if they are not insured, am I just screwed?

Any suggestions?

Read this from the Motor Insurers Bureau of Ireland:-

Don't forget to tell your insurance company about what happened.

Even if you are insured third party only you should be able to claim from the MIB Ireland.

If the other car was UK registered, the UK MIB might be able to help. You can swap your Irish licence for a UK one if the insurance companies are causing difficulties for insuring the new car.

I don't think the UK MIB will help first off-for them to help the vehicle has to be registered and insured in the UK.

Unless there is a tie-up between the two organisations.

That's why I advised the lady to approach the Irish MIB first.

As I wrote, the UK MIB may be able to help. If a non-insured driver hit a pedestrian they would have a claim because the scheme is to provide compensation for accidents caused by non-insured vehicles, not one for compensating damage caused to UK insured vehicles by non-insured vehicles. As such, I would have thought that it is irrelevant that the vehicle damaged is not registered in the UK. Worth contacting them to see.

Turns out the other car was insured!

I just found out today. They have taken my car to the garage for repairs but I have a feeling they are going to come back and tell me it's a write off.

It's a 16 year old car and damage is quite extensive.

If this happens, they will offer me cash in lieu. However, this cash isn't going to do me much good seeing as I can't use it to buy another Irish car. Do they take this into consideration at all? The fact that I spend 2 days taking this car over on the ferry so that I would have a car while I was here and some idiot just plows into it and it's gone? And all I get is market value? That doesn't seem fair.

I thought the law with no fault accidents is that you should not be inconvinienced in any way and be put back into the position you were before the accident. I want and can only currently drive an Irish automatic car.

Will this matter at all?
