Fault not fixed before warranty expired - what are my rights?

My vehicle was covered by Nissan warranty. I reported a problem to the dealer six months ago which has appeared again (I suspect it actually wasn't fixed and no new parts were ever fitted).

The question is - legally are they responsible because I reported the fault within warranty? It is not my fault that their delayed response allowed the warranty to expire.

Yes. You are in the right and you have as a matter of record the evidence that you asked for the fault to be fixed before the warranty expired.
