Should I fight a variable speeding ticket?

I regularly use the M1 between, junction 10 and 13, where the variable speed limit signs are permanently on even if the road is completely clear. In fact, people have got so used to this that they ignore the variable limits and drive along at 70mph.

Last week I received notification of a summons for driving at 74mph through a variable 60mph limit. I have the choice of accepting a three point penalty and a fine or go to court. Do I have any legal standing that the variable spend signs have been faulty for so many years or must I learn from the experience and move on?

A female barrister did take this matter to court and won, but I can't find the ruling. She was on the M42, the road was completely clear and the 'smart motorway' limits were in force. Her argument was that there was no reason for the reduced limit and she won.

The whole situation is a bit bizarre. Coming South on a Sunday they slow everything down round about Newport Pagnell, but further on the limits can go up or down seemingly randomly. I think your problem is the 74mph. To be doing that your speedo must have been showing close to 80 and that's what you really got done for.
