I want to reject my faulty new car - what can I do?
I took delivery of a brand new Volkswagen Polo on 9/8/2013. Within two weeks water was seen in the drivers and passenger foot wells. Also the foot well behind the drivers seat.
After 3 attempts at a repair I was told that they could not find any problem. On the second attempt, which required removal of the offside front wing, the dealership held the car for just under five weeks.
When I got the car back it was still leaking. The third attempt at a repair I was told that the dashboard would have to be removed and anything else that would aid the inspection.
I said that I am not prepared to accept this as this is beyond acceptable for a brand new car. I rejected the car under the sale of goods act as not being fit for purpose. The dealer agreed and said that they would exchange the car for a new car (same model) at no extra expense or depreciation to my self, as I have had the problem from more or less day one of receiving the car.
I was told that they could not give me a new car until they were given the go ahead from Volkswagen head office. I find this strange as my contract is with the Volkswagen dealership and not with Volkswagen. We are now into march 2014 and I am still no nearer to getting a new car.
With all the rain we have had the floor of the car is one big puddle. Any contact with the dealership by phone for an update or something to be done about the water has been totally ignored.

The contract is between you and the dealer. The car was not of 'satisfactory quality' so the dealer either had to replace the car or give you your money back. Law here:www.honestjohn.co.uk/faq/consumer-rights/ Any more mucking about, get a solicitor involved.
