Can I have the DPF removed from my Volkswagen Golf estate?

A local company has offered to remove the DPF from my Golf estate, reprogram the ECU and leave it looking identical underneath. They claim better mpg and power and, obviously, no blockages caused by short journeys. Would it pass an MoT in this condition and would it work?

Currently it will pass an MoT because the law is not enforced. But this is an illegal modification under EC Emissions Directives, so at any time in the future, without warning, the law could be enforced and you could even be stopped at a VOSA roadside check and have your car impounded.
