Should my daughter buy this used C-Max which has an HPI discrepancy?
I am trying to buy a car for my daughter (Ford Focus C-Max 2004 2.0-litre TDCI, 88,500miles at £2800) from a private seller who says that he works for a garage. He said that the Focus came in as a part-exchange and he has bought it from his garage and is selling it on. I am part way through doing an HPI Premium Check; the registration mark presents no problems, and the seller has given me the V5 serial number and issue date, however he is not listed on the V5 as the registered keeper of the vehicle. He has not sent the V5 to DVLA because he wants to sell it on quickly. I note that HPI's terms and conditions state: "If the vehicle is bought privately then you must purchase it from the keeper and at the address stated on the V5. You must verify the identity of the seller against those on the V5."
I should think this condition is there for a very good reason, and HPI states that if this term was not conformed with any claim against HPI for financial loss would be affected. Is there any sensible way forward (my daughter is very keen on the car) or should I just walk away?

I've heard that story before. The guy probably bought the car at auction and he is not a private vendor, he is a small time dealer. If you buy from a dealer you are protected by consumer legislation. The problem is, he may be so small time that he has no assets, so even if you won a case against him you would get nothing. However tempted she may be, best to walk away.
